<br />Motion by Chairperson Nixt, seconded by Commissioner Cleveland, to recommend that the City <br />Council grant approval of the proposed site plan contingent upon the compliance with City Staff <br />Review Letter dated June 1 st, 2007, with the caveat that staff is directed to work with the <br />applicant regarding a design noting the landscaping concerns and making the appropriate <br />recommendation for resolving those concerns. <br /> <br />Motion Carried. Absent: None. <br /> <br />Case #7: <br /> <br />Public Hearing - Request to Rezone from R-l Single Family Residential to <br />Planned Unit Development (PUD) for Bridgewaters; Case of CBR <br />Development <br /> <br />Chairperson Nixt dosed the regular portion of the Planning Commission meeting at 8:50 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearin2 <br /> <br />Chairperson Nixt called the public hearing to order at 8:50 p.m. <br /> <br />Presentation <br /> <br />Associate Planner DaInes stated on May 4, 2007, CBR Development submitted a Planned Unit <br />Development rezoning application,.in conjunction with a preliminary plat application to develop <br />5 single-family lots on t~e property located to the east of Nowthen Boulevard and north of <br />Sunwood Drive at 14765 Nowthen Boulevard. Ms. DaInes stated the proposed lots meet the <br />minimum lot size in terms of area. However, 4 of the 5 lots fail to meet lot width requirements <br />due to the positioning of the lots on the cul-de-sac. Also, the proposed cul-de-sac does not meet <br />the standard requirements for right-of-way radius of 60 feet. Thirdly, the maximum density in the <br />single-family residential district is 3 units per net acre, and this plat is proposing 3.3 units per <br />acre. The size of the property limits the applicant from obtaining an exact 3 units per acre. The <br />applicant is attempting to develop single-family, single-level living units, and is requesting these <br />deviations in order to accommodate this style of housing. Ms. DaInes stated City Code discusses <br />general and specific requirements for allowing zoning amendments to Planned Unit Development <br />(PUD). She reviewed the criteria. <br /> <br />Citizen Input <br /> <br />Chairperson Nixt requested the applicant to respond with any counter 'comments to staff s <br />analysis and the City's attempt to work with the applicant to accomplish the proposed <br />development of the site. <br /> <br />Mr. Tom Rollings, CBR Development, stated he does not know that he has counter comments, <br />other than that he originally came to the City with a 10-unit townhome development, which is <br />what they had earmarked and purchased this site for.
