<br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Cleveland, <br />Hunt, Levine, and Trites Rolle. Voting No: None. Absent: None. <br /> <br />The public hearing was closed at 9:09 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 9:09 <br />p.m. <br /> <br />City Engineer Jankowski advised preliminary plat approval gives the applicant substantial rights. <br />If it is determined that the trail needs to be placed within the subdivision with additional width on <br />the cul-de-sac, the five lot subdivision could be difficult to accommodate. <br /> <br />Commissioner Cleveland indicated there has not been discussion about how many people the <br />homes will accommodate. The public safety issue may be impacted if there are more people <br />living in the homes based on the number of bedrooms. <br /> <br />Associate Planner DaInes advised this is a single family subdivision; the City can require certain <br />design .standards within the PUD, but not minimum or maximum sizes or the number of <br />bedrooms or bathrooms. She would caution against that. <br /> <br />Commissioner Cleveland stated Ms. DaInes is referring to this type of consideration being <br />discriminatory. What she is saying is that there is a public safety issue as to how many people <br />can be accommodated in this small area of cul-de-sac with a short drive going onto a busy road. <br /> <br />Associate Planner DaInes replied that is typically addressed through density, setback, lot widths, <br />and minimum requirements for roads and access, which is why these things need to be <br />considered when granting deviations. <br /> <br />Mr. Rollings stated CBR Development looks at this realistically and their market research shows <br />that single-level living is a need, which is not necessarily for folks with young children. As far as <br />2 or 3 bedrooms, a good reason some of the homes might be 3 bedrooms instead of 2 bedrooms <br />would be for the value of home. He would assume that who they are marketing to or foresee in <br />these units will be less of a safety concern. Even if the 2-story homes are an option they would <br />try to accomplish a plan with the first level living available. <br /> <br />Commissioner Cleveland inquired about access to the nearest park, and if the residents would <br />have to cross Sunwood Drive. <br /> <br />City Engineer Jankowski replied the nearest park is Solstice Park, which is across Sunwood <br />Drive. <br /> <br />Planning Commission/ June 7,2007 <br />Page 21 of31 <br />
