<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-06-132 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0794 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK FOR THE <br />CONSTRUCTION OF A TELECOMMUNICATIONS TOWER IN ALPINE PARK. <br /> <br />WHEREAS, T-Mobile, USA, hereinafter referred to as "Applicant," has properly applied <br />for a variance from the rear yard setback required in Section 9.15.08 Tower Setbacks on the <br />property generally located on Ramsey Blvd and Bunker Lake Blvd and legally described as <br />follows: <br /> <br />Lot 1, Block 1, Alpine Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on June 7, 2007, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the Subject Property is zoned Public-Quasi Public, and telecommunications towers are <br />permitted by conditional use permit within that district. <br /> <br />3. That properties to the north, west, and east are zoned R -1 Residential and the property to the <br />south is zoned publi~-quasi public. <br /> <br />4. That section 9.15.08 Tower Setbacks requires a 30 foot rear yard setback for business and <br />industrial parcels. <br /> <br />5. That the public-quasi public district defers to the B-1 Business Standards concerning <br />performance standards and setbacks for telecommunications towers. <br /> <br />6. That the Applicant is requesting a variance to construct the rear edge of the tower compound <br />with a zero-foot setback to the southern property line. <br /> <br />7. That the tower is situated in the center of the compound, resulting in a 20-foot setback from <br />the southern property line. <br /> <br />8. That Waste Management owns the land immediately south of the proposed compound, and <br />the land use on the property is landfill reclamation. <br />
