<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-06-134 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0795 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE MAXIMUM FRONT YARD SETBACK FROM <br />STREET RIGHT-OF-WAY FOR THE ANOKA COUNTY MEDICAL EXAMINER <br />FACILITY IN TOWN CENTER. <br /> <br />WHEREAS, PSD, LLC, and Anoka County, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.20.25, Subd. 3.b, regarding maximum front yard <br />setbacks from street right-of-way in the TC-3 Sub-district of Town Center on the property legally <br />described as follows: <br /> <br />Outlot GG, Ramsey Town Center Addition, according to the recorded plat thereof, <br />Anoka County, Minnesota <br /> <br />or upon recording: <br /> <br />Lots 1, Block 1, Town Center 13th Addition, according to the recorded plat thereof, <br />Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on June 7, 2007, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the proposed Lot 1, Block 1, Ramsey Town Center 13th Addition is zoned Sub-district <br />TC-3, and is approximately 1 acre in size. <br /> <br />3. That the remainder of Outlot GG is zoned TC-3. <br /> <br />4. That the City has received a site plan application from the Applicants to develop a new <br />facility for the Anoka County Medical Examiner on the Subject Property. <br /> <br />5. That Section 9.20.25, Subd. 3.b, establishes a minimum front yard setback of 0 feet and a <br />maximum front yard setback of15 feet, as measured from,building front to edge of right- of- <br />way. <br /> <br />6. That the site plan reflects that the setback of the proposed building ranges from 13 to 53 feet <br />from the street right-of-way. <br />
