<br />7. The reason for sitting the building beyond the front yard setback maximum is to preserve <br />space for a future building expansion, which for interior functional reasons makes the most <br />sense to occur on the west side of the building facing Rhinestone Street. <br /> <br />8. That when the future expansion occurs, the entire length of the building will be in compliance <br />with the 15 foot maximum setback from street right-of-way. <br /> <br />9. That the variance from street right-of-way applies to Rhinestone Street, which is a not a <br />highly visible town center corridor like Sunwood Drive or East and West Ramsey Parkway. <br /> <br />10. That in the interim time period between initial construction and future expansion, the site <br />plan has been designed to use architectural and landscaping features, such as patios, <br />decorative wrought iron fencing, plantings, entry canopies extending to sidewalk, etc., to <br />create the feeling that the building is closer to the street than it appears. <br /> <br />11. That the Applicant has stated the variance requested is the minimum variance needed to <br />alleviate the hardship and preserVe appropriate space for future expansions. <br /> <br />12. That if granted, the variance will not permit a use that is prohibited in the Town Center TC-3 <br />Sub-district. <br /> <br />13. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property . <br /> <br />14. That if granted, the variance will not endanger the public safety. <br /> <br />15. That if granted, the variance will not unreasonably diminish property values In the <br />neighborhood. <br /> <br />16. That if granted, the variance will not violate the intent of the Comprehensive Plan or the <br />Town Center Guidelines. <br /> <br />17. That, if granted, the variance will not grant the Applicants any special privilege that is denied <br />to other owners of land in the same district. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Trites Rolle, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Van Scoy <br />Board Member Nixt <br />Board Member Trites Rolle <br />Board Member Brauer <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Levine <br /> <br />RESOLUTION #07-06-134 <br />Page 2 of3 <br />
