<br />Councilmember Elvig moved for the adoption of the following resolution: <br /> <br />RESOLUTION #07-06-151 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0796 RELATING TO A <br />REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR CHARLES <br />DELANEY TO MAINTAIN A COMMERCIAL KENNEL OPERATION AND MORE <br />THAN ONE RESIDENTIAL STRUCTURE ON ONE (1) LOT OF RECORD. <br /> <br />WHEREAS, Charles Delaney, hereinafter referred to as "Applicant", has properly <br />applied for an amended Conditional Use Permit (Permit) on the property generally known as <br />8404 161 st Avenue N.W. and legally described as follows: <br /> <br />The Southeast Quarter of the Northwest Quarter and the Northeast Quarter of the <br />Southwest Quarter of Section 17, Township 32, Range 25, Anoka County, <br />Minnesota. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on June 7, 2007, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />2. That the subject property is located in the R-l Residential Rural Developing District. <br /> <br />3. That the surrounding parcels are zoned R-l Residential Rural Developing and Planned Unit <br />Development (PUD). <br /> <br />4. That Section 9.11.01 of City Code states that in no case shall there be more than one main <br />building on anyone lot. <br /> <br />5. That a commercial dog kennel has been maintained and operated on the property since <br />1926, and is considered a pre-existing non-conforming use in the R-l Residential: Rural <br />Developing District. <br /> <br />6. That on November 13, 1990 the City Council issued a Conditional Use Permit (CUP) to <br />the Subject PropertY to maintain a commercial kennel operation and four residential <br />structures on one lot of record. <br /> <br />7. That the terms of the CUP issued in 1990 required that any proposed expansion of the <br />kennel operation will require application for an amended conditional use permit. <br />
