<br />most cases people are good about cleaning up. He cannot see charging someone $40 that is <br />fairly cooperative and responds to the letter. They may not have realized that anything was <br />wrong. <br /> <br />Councilmember Elvig stated he received phone calls too. He thinks this is a good ordinance. As <br />they learned with the cluster ordinance they can do their best job to anticipate every situation <br />coming forward, but they are not done with this. It is a step in the right direction. The City has <br />had a lot of problems with neighbors that have a lot of junk. They will have to walk slowly and <br />answer questions as they come up. <br /> <br />Councilmember Jeffrey stated he agrees if they are going to have a fee for the first time they <br />need to put the ordinance in effect for a while and see how it plays. The fee could be put out for <br />some time in the future to be noted, so that people know on January 1 of whatever year there will <br />be a fee assessed for staff coming out to review a complaint. He pointed out that what might be <br />a complaint to one person might not fit the ordinance and they would then be charging someone <br />for something that does not fit under the ordinance. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Olson, to adopt Ordinance #07- <br />11 establishing an abatement program for code enforcement purposes in the City of Ramsey. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Dehen: aye <br />Councilmember Elvig: aye <br />Councilmember Jeffrey: aye <br />Councilmember Look: aye <br />Councilmember Olson: aye <br />Councilmember Strommen: aye <br /> <br />Motion carried. <br /> <br />Case #3: <br /> <br />Confirm Settlement Terms for Acquisition of Sparkle Pool Services, Inc.'s <br />Property Located at 14105 Azurite Street <br /> <br />City Attorney Goodrich reviewed that Council authorized eminent domain action to acquire the <br />property located at 14220 Basalt Street in 2006 for economic development purposes. On June 5, <br />2007, Council met in closed session to further discuss this acquisition. The consensus of the <br />Council at that time was to accept a negotiated purchase price of $315,000 pending no <br />environmental issues. This negotiated amount includes relocation expenses. NT!, Inc. has <br />reviewed the site and determined there are not recognized environmental conditions on the site. <br />Included in the Council's packet is the Stipulation of Final Settlement signed by the property <br />owner's attorney. <br /> <br />Councilmember Look stated this is a nice way of saying that this is a forced sale through eminent <br />domain. Case Nos. 3 and 4 skirt the eminent domain law, which has changed for good reason, <br />and in Case No.4 the gentleman is trying to operate a small business.
