<br />Ms. Jacklyn Abendroth, 15810 Sodium Street NW, stated there is not even a right turn lane onto <br />157th Lane, and that is a problem. She questioned what they are going to do with County Road 5 <br />and stated that is also a problem. Ms. Abendroth stated they were at the first meeting when this <br />went to the secretarial service, and it was said at the time that the use of this property for a <br />day care was through a conditional use permit that was supposed to be approved by the City <br />Planning Commission and the Council before it was even considered. Tonight is sounds like it's <br />a given deal. She would like to go back to those minutes at the time of the original sale and have <br />that reviewed. <br /> <br />Ms. Lublin stated when the church was located here there was a daycare there as well; children <br />were there every day. A year or so before the church moved out they had two temporary <br />buildings on the north side of the parking lot for their activities. <br /> <br />Associate Planner Geisler indicated that the 1991 permit specifically calls out the daycare as a <br />permitted use. <br /> <br />Chairperson Nixt directed staff to provide the minutes of the Planning Commission meeting for <br />the original permit to Ms. Abendroth. <br /> <br />Commissioner Brauer noted with the re-approval of the permit last fall the daycare was <br />specifically listed as a permitted use. <br /> <br />Chairperson Nixt noted the City Engineer has pointed out additional street improvements would <br />be nice but cannot be imposed as a condition. He will repeal that request and just go with the <br />screening and buffering requirements. <br /> <br />Commissioner Brauer inquired about limitations on the size of the deli. He noted the hours are <br />proposed as 6:00 a.m. to 6:30 p.m., and until 2:00 p.m. on weekends. <br /> <br />Chairperson Nixt asked if this would be amenable to the applicant. <br /> <br />Ms. Lublin indicated the deli could be open to 4:00 on the weekend. <br /> <br />Commissioner Levine suggested hours of 6:00 a.m. to 6:30 p.m. 7 days per week. <br /> <br />Motion by Commissioner Hunt, seconded by Commissioner Trites Rolle, to approve the request <br />for an amendment to the Northern Counties Secretarial Services Conditional Use Permit, based <br />on the findings of fact, and contingent upon site plan approval and the following additions and <br />amendments to the conditions: <br />· Addition of condition number 11 as follows: "Additional buffer and screening to be <br />added consistent with the requirements between B-1 and R-1 districts." <br />· Addition of condition number 12 limiting the deli by pulling out the following paragraph <br />on page 19: "A coffee shop/deli of approximately 1000 square feet, with seating inside <br />for 24 (approximately 6 tables) and an outside three season patio for an additional 24 <br />(approximately 6 tables). <br /> <br />Planning Commission/ July 11, 2007 <br />Page 13 of21 <br />
