maintain a staff of qualified firefighters at the Ramsey and Burns fire stations to <br />answer fire calls and to operate available equipment in such a manner so as to not at <br />any time fall below minimum standards set forth for a fire department. It is the intent <br />of the parties that the personnel assigned to the Burns fire station remain assigned to <br />that fire station during the term of this Agreement, provided, however, that Ramsey <br />may substitute personnel assigned to such stations as it believes necessary to deliver <br />the emergency response services required by this Agreement. <br />F. As requested by the Fire Chief from time to time, Burns shall assist in fire fighter <br />recruitment efforts within Burns. <br />4. OPERATIONAL CONTROL OF FIRE AND RESCUE OPERATIONS. <br />A. Operational control of fire and rescue operations shall be vested in the Ramsey Fire <br />Chief. The Fire Chief or his designee shall have the authority to determine the type <br />of emergency response, the deployment of personnel and equipment to such <br />emergency, and the methods of responding to such emergency. <br />B. In the event of simultaneous emergencies in both Burns and Ramsey, the Fire Chief <br />or his designee shall have the sole authority to determine which emergency shall take <br />precedence, or if both will be responded to simultaneously. Neither Burns nor <br />Ramsey shall require that the emergency in its respective jurisdiction take precedence <br />over the emergency in the other jurisdiction. <br />C. All equipment and personnel covered by this Agreement may be utilized to assist any <br />neighboring fire department as set forth in any agreement of mutual aid entered into <br />between Ramsey and a neighboring fire department. <br />D. With the exception of mutual aid contracts, neither Burns nor Ramsey shall enter into <br />any agreement with another City to provide fire service during the term of this <br />Agreement, unless one party has already served notice on the other party to terminate <br />this Agreement early. <br />5. FUNDING AND FEES FOR SERVICES PROVIDED <br />A. Burns shall annually budget for and provide adequate funding to maintain its fire <br />station, all apparatus and equipment it is providing under this Agreement, and all <br />charges for personnel and fire or rescue apparatus that Ramsey will bill Burns under <br />this Agreement. <br />B. Ramsey shall annually budget for and provide adequate funding to maintain its fire <br />stations, its fire department personnel, all apparatus and equipment it is providing <br />5 <br />—228— <br />
