• City Code dealing with the terms and removal of board and commission members, <br />including the code of conduct, expected conduct of board and commission members, and <br />consequences of engaging in inappropriate conduct as a board or commission member. <br />• Dictionary definition of the term disrepute and discredit <br />City Attorney Goodrich advised it needs to be considered whether this individual is bringing the <br />City into disrepute or reflects discredit on the person as a board or commission member of the <br />City, as is outlined in City Code. He advised Council may want to consider an amendment to the <br />City ordinance to include the board and commission members as at -will positions. State law <br />allows removal of at -will board and commission members at any time for any reason when in <br />City Council judgment the public welfare is promoted by such removal. Mr. Goodrich advised <br />without an amendment to the City ordinance, the relationship between the City and the EDA <br />member needs to be complied with as outlined above. <br />Chairperson Jeffrey stated he sees two issues. One is that there is an issue with a commission <br />member who fails to meet the abatement ordinance that was just passed, and this individual has <br />been cited for this in the past. The other issue is that this person has violated the attendance <br />policy. The standard procedure for the attendance policy has been to send a letter informing the <br />individual that they are not in compliance with the requirements. He asked when the term ends <br />for this individual. <br />City Attorney Goodrich replied the term will expire December 31, 2008. <br />Human Resources Manager Reed Kone indicated effective at the end of June, this individual has <br />violated the attendance policy by missing three meetings within a six month period of time. The <br />language in City Code states that the Council may terminate the person for a violation of the <br />attendance policy, but the last time this issue was brought to Council the direction was to send a <br />warning letter. <br />Chairperson Jeffrey asked if this person has received a violation in the past for attendance. <br />Human Resources Manager Reed Kone responded in the negative. <br />Chairperson Jeffrey asked if a letter is automatically triggered regarding the attendance, or if it <br />requires action by the Personnel Committee. <br />Human Resources Manager Reed Kone indicated it was brought to Council one time and the <br />Council direction was to send out the warning letter. There was an issue with a board member <br />after that and the previous city administrator recommended that she send out the warning letter. <br />Councilmember Olson asked if a warning letter has been sent to this individual. <br />Human Resources Manager Reed Kone responded in the negative. <br />Councilmember Olson stated the attendance is a bigger issue to her than the other issues. <br />Personnel Committee / July 24, 2007 <br />Page 2 of 6 <br />
