<br />Ms. Abendroth questioned what the situation will be if this business fails. <br /> <br />Councilmember Strommen explained the property is still zoned residential. <br /> <br />Community Development Director Trudgeon indicated there would likely be interest III <br />something being done on the site. Any requests would need to be considered at that time. <br /> <br />Councilmember Look inquired about the time frame on the conditional use permit. <br /> <br />Community Development Director Trudgeon indicated there is not an expiration date on the <br />permit. <br /> <br />Councilmember Look stated he understands that the 91 children is full capacity for the daycare, <br />whether or not that is achieved. He would be interested in reviewing this to determine whether <br />or not there is a conflict created with the neighborhood with things like traffic, etc. <br /> <br />Councilmember Strommen questioned if there is an ability to consider the daycare, as it is <br />already allowed under the original conditional use permit. <br /> <br />Community Development Director Trudgeon advised the applicant is stating they would like an <br />amendment to the permit. In consideration of that the Council may want to include some <br />stipulations on that. His understanding is that the Council would like an opportunity to review <br />this if it becomes a dangerous situation. <br /> <br />Councilmember Look indicated he does not think the deli will cause problems, but the kids may. <br />Once this is on the ground running and they see how things like the traffic flow works, they may <br />want the flexibility to work it to a more acceptable situation. <br /> <br />Councilmember Dehen expressed concern regarding the possibility of the applicant investing <br />time and money into the site and the City pulling the rug out from under them in five years if <br />they do not like the traffic flow. <br /> <br />Mayor Gamec pointed out that daycares are inspected and well regulated by the County and <br />State, and those regulations would determine the number of children that would be allowed. <br /> <br />Councilmember Olson stated the Council is dealing with the deli tonight; the daycare has already <br />been dealt with. Any comments relating to the daycare are really a moot point because that was <br />passed a long time ago. The Council needs to focus on the deli. <br /> <br />Ms. Lublin stated when she bought the property almost 16 years ago; Mr. and Mrs. Abendroth <br />were the people against it. It did pass, and it was a perpetual agreement that they would be able <br />to expand to 2,200 square feet of professional space, and the City Council at that time wanted a <br />daycare. After she bought the property she had it surveyed and found out that the Abendroth's <br />driveway turn out was on her property, and they could not really get into their garage without <br />that. The Abendroth's have been paying her $30 per year to rent that to keep her property rights <br />established.
