<br />project and was going to put it on the north end. At that time she gave them ten feet all along <br />their property line because she thought it was the right thing to do. She talked to them about the <br />daycare and deli, and they were fine with it. They were anxious to get that ten feet. When the <br />Abendroth's came to the Planning Commission meeting she thought they were there to support <br />it. They were fully informed when she gave them that ten feet of property of her intentions. She <br />does not understand the intent for doing this now. <br /> <br />Ms. Abendroth stated they really appreciate Ms. Lublin giving them the ten feet, but they could <br />have changed that if she had wanted to push the issue. Regarding the daycare, this is in a <br />walking area, so the children at the daycare would have to either walk from there or be bussed <br />from there, which she believes is an additional $200 per child. That might stop people from <br />coming to her daycare. <br /> <br />Mayor Gamec indicated there are conditions in the conditional use permit that allow the daycare. <br />The deli and the expansion are what is being considered tonight. <br /> <br />Ms. Abendroth stated she would have no problem with that; it is the expansion and the number <br />of children they are bringing in. She has no objection to a daycare, but the size of it is getting <br />out of hand to her. <br /> <br />Mayor Gamec stated this is regulated by the State or County. The City could limit it, but <br />generally they go with the State or County regulations based on the capacity for fire, etc. <br /> <br />Ms. Abendroth indicated her understanding is that the City can zone the property and allow the <br />building, but the rest of it is up to the State. <br /> <br />Mayor Gamec replied that is correct as far as regulating the daycare. <br /> <br />Ms. Abendroth questioned if this is becoming a commercial property. <br /> <br />Mayor Gamec replied this is under a conditional use permit as a permitted use due to it being a <br />church at one time. <br /> <br />Ms. Abendroth stated she does not remember ever agreeing to anything as far as the daycare <br />goes. <br /> <br />Mr. Louis Abendroth, 15810 Sodium Street NW, stated this was brought before the Planning <br />Commission, and the first thing the Chairman said was that he lived in that neighborhood and <br />would like the deli where he can go by every morning and stop for a cup of coffee. Mr. <br />Abendroth stated he was defeated before starting; the Chairman was in favor of this. He <br />requested clarification on the deli and the number of tables and chairs that will be allowed. He <br />stated at one time Ms. Lublin said she would have a deli and will have trucks to deliver to the <br />surrounding stores. <br /> <br />City Council / July 24, 2007 <br />Page 12 of 19 <br />
