<br />~ <br /> <br />- 2 - <br /> <br />is and shall be held, transferred, sold, conveyed, used and <br /> <br />occupied sUbject to the covenants, conditions, restrictions, <br />easements, charge' and liens hereinafter set forth. <br /> <br />ARTICLE I <br /> <br />DEFINITIONS <br /> <br />Section 1.1 The followi~g words, when used in this <br />Declaration (unless the context shall prohibit), shall have the <br /> <br />following meanings: <br /> <br />a. The Common Driveway shall not <br />be for the use and enjoyment of any other Lot o~~ers. <br /> <br />e. "Declarant" shall mean and refer to Menkveld Co., a <br />Minnesota corporation, its successors and assigns, if <br />such successors and assigns should acquire any <br />undevaloped portions of the Pr~perty from the Declarant <br />for the purpose of Development. <br /> <br />f. "First Mortgagee" shall mean and refer to any person <br />named as a mortgagee under any mortgage against a lot, <br />which mortgage is first in priority upon foreclosure to <br />all other mortgages against said lot, or any successors <br /> <br />
