The rights <br />bestowed upon Owners and Occupants by this Paragraph 14.3 shall <br />be the sole and exclusive remedy of such Owners and Occupants <br />with respect to the matters covered by this Article) except as <br />may be specif~cally authorized by statute or by the Governing <br />DocuI:lents. <br />Section 14.4 Costs of Proceeding and Attorneys Fees. In any <br />.legal or.arbitration proceeG~ng (exclusive of any proceeding <br />authorized under this Article XIV) arising between the <br />Association a~d an Owner or Occupant, or between Owners or <br />Occupants, because of an alleged default or violation by an Owner <br />or Occupant, the Association shall) if it prevails as to any <br />material part of the relief sought) be entitled to recover the <br />costs of the proceeding and such reasonable attorneys' fees as <br />may be determined by the court or arbitration board. In any <br />situation in which the Association has incurred costs and <br />expenses, including attorneys fees) in order to collect unpaid <br />monthly assessments or to correct any other default or violation <br />by an Owner or Occupant of the provisions of the Governing <br />Documents) the ~'ner or Occupant who has caused the Association <br />to incur such costs and expenses shall be responsible therefor <br />and such costs and expenses shall become an assessment against <br />such O~~er's or Occupant's House. <br />Section 14.5 Liability for Owners'and OccUDants' Acts.
