<br />The order shall specify those sections of the Code involved, describe the violation and shall <br />direct that the violation be corrected within five (5) days from the date of the order. <br /> <br />Subd.2. If the Zoning Administrator or Building Official fmds that a sign is abandoned or is <br />structurally, or electrically defective, or in any way endangers the public, the Zoning <br />Administrator or Building Official shall issue a written order to the owner of the sign and <br />occupant of the premises stating the nature of the violation and requiring repair or removal of the <br />sign within sixty (60) days of the date of the order. <br /> <br />9.12.19 <br /> <br />Enforcement <br /> <br />Subdivision 1. Enforcement of the sign ordinance shall be conducted by <br />the Zoning Administrator and/or their assigns. Signs not complying with the sign <br />ordinance, as witnessed and documented by the Zoning Administrator, will be <br />subj ect to the below procedure. <br /> <br />Su bdivision 2. When a violation of Section 9.12.03 Subdivision 1 <br />(Location) is witnessed by the Zoning Administrator or other law enforcement <br />official, the City reserves the right to remove the sign from the public right-of- <br />way immediately, without notice. The sign will subsequently be discarded. <br /> <br />Subdivision 3. When a violation of any other provision of this ordinance <br />has been witnessed, the following actions will be taken by the City: <br /> <br />a. Written Notice. Written notice will be made that the property owner is in <br />violation of the sign ordinance, and 5 business days will be given for <br />corrective action. <br /> <br />b. Notice of abatement or issuance of administrative citation. After the 5 <br />business days have passed, if the sign remains, the City will follow with an <br />administrative citation and/or a notice of commencement of abatement <br />procedures, in accordance with Section 5.19 Enforcement and Penalties <br /> <br />Subdivision 4. The owner of the parcel upon which the sign is located <br />shall be presumed to .be the owner of all signs thereon unless facts to the contrary are brought to <br />the attention of the Zoning Administrator. <br /> <br />Subdivision 5. In case of emergency, the Zoning Administrator or <br />Building Official may cause the immediate removal of a dangerous or defective sign without <br />notice. Signs removed in this manner must present a hazard to the public safety as defmed in the <br />State Building Code. <br /> <br />9.12.20 Appeals. To provide for a reasonable interpretation of the provisions of this <br />Ordinance, a permit applicant who wishes to appeal an interpretation by the Zoning <br />Administrator may file a written appeal with the City Administrator and request a hearing before <br /> <br />87 <br /> <br />
