<br />a Hearing Examiner, in accordance 'with Section 5.08 Public Nuisances. The Hearing Examiner <br />shall hear the appeal, make fmdings and take its action. <br /> <br />9.12.21 Variations. Request for variations from the provisions of this Section shall be <br />processed by the applicant applying to the Zoning Administrator for a conditional use permit, <br />which conditional use permit procedure shall be as prescribed in Section 9.03.05 of the City <br />Code. <br /> <br />9.12.22 Conflict. If any portion of this Section is found to be in conflict with any other <br />provision of any zoning, building, fIre, safety or health ordinance of the City Code, the provision <br />which establishes the higher standard shall prevail. <br /> <br />9.12.23 Severability. If any subsection, sentence, clause, or phrase of this Section, or its <br />application to any person or circumstance is held invalid by the decision of any court of <br />competent jurisdiction, the remainder of this Section, or the application of the provision to other <br />persons or circumstances is in effect and shall remain in full force and effect. \ <br /> <br />9.12.24 Substitution. The owner of any sign which is otherwise allowed by this sign <br />ordinance amy substitute non-commercial copy in lieu of any other commercial or non- <br />commercial copy. This substitution of copy may be made without any additional approval or <br />permitting. The purpose of this provision is to prevent any inadvertent favoring of commercial <br />speech over non-commercial speech, or favoring of any particular non-commercial message over <br />any other non-commercial message. This provision prevails over any more specific provision to <br />the contrary. <br /> <br />SECTION 5 <br /> <br />SUMMARY <br /> <br />The following official summary of Ordinance #07-08-_ has been approved by the City <br />Council of the City of Ramsey as clearly informing the public of the intent and effect of the <br />Ordinance. <br /> <br />This Ordinance #07-08-_ replaces the existing sign ordinance with a revised sign ordinance <br />that eliminates all content-based regulation and addresses problems identifIed in the <br />administration of the previous sign ordinance. <br /> <br />SECTION 6 <br /> <br />EFFECTIVE DATE <br /> <br />The effective date of this ordinance is thirty (30) days after its passage and publication, subject to <br />City Charter Section 5.07, <br /> <br />Adopted by the Ramsey City Council the _ day of <br /> <br />,2007. <br /> <br />88 <br />
