Staff s~eks further policy direction and specificity regarding the following items:

1. Garbage can regulations. Staff is seeking further direction from the entire
Council on this issue. Any changes to the regulations regarding garbage cans are
most appropriately addressed through an amendment to Chapter 9 of the City
Code.

2. The definition of "nighttime." Staff recommends maintaining the "nighttime"
definition to begin at 10 p.m. This is a commonly accepted time among other
cities' ordinances and represents park hours and weekend curfew for children and
the weekday curfew for younger teenagers.

3. Varying yard maintenance standards for urban vs. rural parcels. This subject also
is more appropriately addressed in Chapter 9 performance standards for
residential districts.

Staff will bring forward Chapter 9 changes based on Council discussion of these issues.

Funding Source:

Implementation/administration of the administrative citation and abatement process will be an
additional budget consideration with the Police Department.

Staff Recommendation:

Staff recommends adoption of the ordinance as presented.

Council Action:

Motion to adopt Ordinance #07-_ to amend Chapter 5 (Municipal Regulations) of City Code
regarding Public Nuisance, Weeds, and Condition of Premises.

Roll Call Vote:

Councilmember John Dehen
Councilmember David E1vig
Councilmember Mary Jo Olson
Councilmember Sarah Strommen
Councilmember David Jeffrey
Councilmember Matt Look
Mayor Tom Gamec

Review Checklist:
Assistant Community Development Director
Police Chief
City Attorney

CC: 9/11/07

-194-
