UPDATE ON T.H. #47 LOCAL INITIATIVE PROJECT <br /> By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />You may recall from the March Road and Bridge Committee meeting that MnDOT was <br />considering the elimination of turning movements at 142nd Avenue and T.H. #47 as a condition <br />of participation in our local initiative project. I had met with MnDOT representatives on <br />February 27th to discuss this and other issues related to this project. MnDOT agreed to review <br />this issue with its layout review committee, and their current position is outlined in the attached <br />letter from Mr. Kevin Hoglund dated March 21, 1997. <br /> <br />The issues raised in items 2, 4, 5, and 6 are technical in nature, however, items 1 and 3 have a <br />significant bearing on the progress of this project. In item 1, MnDOT acknowledges that 142nd <br />Avenue should remain open as proposed in the City's original layout. MnDOT apparently has <br />not yet concurred that signal justification warrants have been met for this intersection. I am <br />reviewing this issue with our consultant. <br /> <br />Item 3 has a significant impact financially on this project as it requests that access control on <br />both sides of T.H. #47 be deeded to the State for virtually the length of the project. Access <br />control would need to be acquired from the following properties: <br /> <br />· Six single family lots in Flintwood 3rd <br />· Dan Laws property <br />· Lord of Life Church <br />· Amoco <br />· Landmark Bank <br />· Northland Bank <br />· Art Raudio property <br />· Rick Foster property <br /> <br />Although access control can be obtained through eminent domain power of the State, it is a <br />compensable right, and since MnDOT has limited its participation to a lump sum of $400,000 <br />this additional cost would presumably need to be borne by the City. The Amoco property is the <br />only existing access which would be closed by the project. However, conversations with Rick <br />Foster, the largest owner of vacant land, indicates that he would be requesting the following in <br />consideration for dedicating access control: (a) two additional right in/right out access points <br />onto T.H. #47; (b) MnDOT deed back right-of-way originally dedicated by him 10 feet beyond <br />the ultimate curbline; and (c) forgiveness of a clause in the development agreement for River's <br />Bend 4th which requires him to pay 50% of the cost of the Xkimo leg connection to T.H. #47. <br />Mr. Foster also estimated the access value to T.H. #47 in excess orS100,000. <br /> <br /> <br />
