<br />Mn/DOT Agreement No. 91083 <br /> <br />CFMS Contract No. <br /> <br />STATE OF MINNESOTA <br />J;OINT POWERS AGREEMENT <br />FOR PROFESSIONAL/TECHNICAL SERVICES <br /> <br />State Project Number (SP): 0202-90 Trunk Highway Number (TH): 10 <br />Anoka County Project Number: SP 199-010-09, Federal No. HPPHHI96(002) <br /> <br />Project Identification: TH 10 Preliminary Design in Anoka County <br /> <br />This Agreement is between the State of Minnesota, acting through its Commissioner of Transportation <br />("State"), Anoka CountY, through its Board of Commissioners, address: 1440 Bunker Lake Boulevard, <br />Andover, MN 55304 ("County") and City of Ramsey, through its City Council, address: 7550 Sunwood <br />Drive NW Ramsey, MN 55303 ("City"). <br /> <br />Recitals <br />1. Minnesota Statutes 915.061 authorizes State to engage such assistance as deemed necessary. <br />2. Minnesota Statutes S471.59 authorizes State, County, and City to enter into this Agreement. <br />3. State is in need of a preliminary design of TH 10 from approximately a half a mile west of County State Aid <br />Highway (CSAH) 56 (Ramsey Boulevard) to a half mile east of CSAH 57 (Sunfish Lake Boulevard) <br />including further development of interchange designs for these two intersections with TH 10. The project <br />limits are within Anoka County and the City of Ramsey. <br />4. County represents that it is duly qualified and agrees to perform all services described in this Agreement to the <br />satisfaction of State. <br /> <br />Agreement <br />1 Term of Agreement; Survival of Terms; Incorporation of Exhibits <br />1.1 Effective date: This Agreement will be effective July 1, 2007 or the date State obtains all required <br />signatures under Minnesota Statutes Section 9 16C.05, subdivision 2, whichever is later. <br />1.2 Expiration date: This Agreement will expire on May 1, 2009, or when all obligations have been <br />satisfactorily fulfilled, whichever occurs first. <br />1.3 Survival of Terms: All clauses which impose obligations continuing in their nature and which must <br />survive in order to give effect to their meaning will survive the expiration or termination of this <br />Agreement, including, without limitation, the following clauses: 6. Liability; 7. State Audits; 8. <br />'Government Data Practices; 9. Intellectual Property Rights; and 10. Venue. <br />1.4 Exhibits: Exhibits A and B are attached and incorporated into this Agreement. <br /> <br />2 Scope of Work and Deliverables (all activity code 1129) <br />2.1 Pursuant to applicable laws, County will enter into a subcontract with a consultant SRF Consulting <br />Group, Inc., to perform the following tasks: <br />2.1.1 Environmental Documentation (Environmental Assessment) <br />2.1.2 Geometric Layout Preparation <br />2.1.3 Cost Estimates <br />2.1.4 Prepare Design Memorandum <br />2.1.5 Project Management, Meetings and Coordination <br /> <br />See Exhibit A for additional information on the Scope of Work and Deliverables. <br /> <br />Payment <br />3.1 Consideration. State will reimburse County with state funds for 100% of the subcontractor costs <br />actually paid by County for work performed under this Agreement up to a maximum of $62,500.00 and <br />under MnlDOT Agreement No. 91096 plus Supplement#1 to that Agreement, incorporated by reference <br />up to $682,760.00 in federal funding for a total of$74~,260.00.County will share equally with City the <br />-383- <br /> <br />n___ 1 .....t'.::. <br />
