<br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on August 2,2007, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned E-l Employment and is approximately 6.2 acres in size. <br /> <br />3. That properties to the north and east are zoned R -1 Residential. <br /> <br />4. That the property to the south and west is street right of way. <br /> <br />5. That self-storage facilities are a permitted use in the E-I Employment District. <br /> <br />6. That Section 9.20.24 (E-l Employment District) requires a sixty (60) foot setback between <br />parcels zoned E-l Employment and those zoned R-l Residential. <br /> <br />7. That Section 9.20.24 (E-l Employment District) requires a twenty (20) foot setback between <br />parking and pavement and adjacent public street right-of-way. <br /> <br />8. That the Applicant previously received approval of a variance to both zoning requirements on <br />November 4, 2004. <br /> <br />9. That the Applicant is requesting a variance from the 60-foot bufferyard requirement along the <br />northern property line of Outlot A, Regency Pond, in order to construct bituminous surface <br />and buildings within 25-30 feet of said property line. <br /> <br />10. That the Applicant is also requesting a variance from the 20-foot pavement setback <br />requirement between any pavement and public street right-of-way, in order to construct a new <br />cul-de-sac at the terminus of 148th Avenue NW. <br /> <br />11. That the Applicant will construct an eight-foot high privacy fence around the northern and <br />eastern property lines of the development site to help mitigate the lesser bufferyard. <br /> <br />12. That the Applicant has stated that given the unusual shape of the subject property it is <br />practically difficult to develop the site to its potential and accommodate a 60-foot bufferyard <br />on the northern property line of Outlot A, Regency Pond. <br /> <br />13. That the variance requested is the minimum variance needed to alleviate the hardship. <br /> <br />14.
