Background: <br />CONSIDER PROPOSED AMENDMENTS TO 5.08 (PUBLIC NUISANCES) OF <br />CHAPTER FIVE OF CITY CODE: <br />CASE OF CITY OF RAMSEY <br />By: Breanne Dalnes, Associate Planner <br />On August 28, 2007, the City Council adopted an ordinance amending Chapter Five to revise <br />Section 5.08 (Public Nuisance) of City Code. During this re -write, a portion of the nuisance section <br />was inadvertently removed. This section specifically addresses the prohibition of tracks and trails in <br />certain areas of the City, and is essential to the police enforcement of this regulation. Staff's <br />intention was to move this portion of City Code to the recreational vehicle section, but after <br />discussion, it is more appropriate in the nuisance section. This ordinance seeks to replace that exact <br />language in the same Section of City Code. The language to be re- inserted is below: <br />Tracks and trails for riding motor vehicles are not allowed in a residential area unless said track or <br />trail is; <br />1. 1000 feet from any residence except that of the owner; and <br />2. At least 50 feet from property lines, public streets, utilities, or easements. <br />Also, item "1" of Section 5.08.04, which states "all public exposure of persons having a contagious <br />disease" was eliminated as being an antiquated "nuisance." <br />Notification: <br />There is no public hearing associated with Ciiy Code amendments from Chapter Five. <br />Funding Source: <br />The Code revisions are being processed with Staff time. <br />Council Action: <br />Motion to introduce Ordinance #07 to amend Chapter Five, as discussed. <br />Review Checklist: <br />Community Development Director <br />Police Chief <br />City Administrator <br />CC: 10/9/07 <br />Case # <br />—105— <br />
