Zoning Administrator Frolik responded that there can be just as much impact with a tower on City <br />property as on private property, and citizens do not have the opportunity to request additional <br />screening if there is no public hearing. <br /> <br />Chairperson Bawden asked if there is any way to issue a permit and hold a public hearing and <br />avoid the cost of a CUP. <br /> <br />Mr. Alexander stated that rather than further delay the ordinance to work out an alternative <br />process, he would prefer going forward with the CUP. Providers are under big time constraints <br />that are required under the FCC license to become operational as soon as possible. <br />It was the consensus of the Commission to leave the requirement of a CUP in the ordinance for all <br />PCS antenna and tower sites on both City and private property in order to allow the public <br />hearing process. <br /> <br />Mr. Alexander requested clarifying language on the size park where a tower site could be <br />considered. <br /> <br />Commissioner LaDue recommended that an inventory of suitable parks for tower sites be <br />prepared. <br /> <br />Mr. Alexander stated that he is not sure a list would help because different towers are used by <br />different providers. Some may be suitable in small parks, and others may need to be in bigger <br />parks. <br /> <br />Motion by Commissioner Holland, seconded by Commissioner Deemer to have the Park and <br />Recreation Commission review this issue and Section 9.15.04 at their next meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, Jensen, <br />LaDue, Terry, and Thorud. Voting no: None. Absent: None. <br /> <br />Commissioner Jensen asked for clarification of Section 9.15.04(c)(1)(iv), regarding the health of <br />workers maintaining the tower. <br /> <br />Mr. Alexander explained that in his firm's first letter, dated January 7, 1997, that issue was <br />explained. It is not within local authority to regulate radio emissions. Radio frequency issues are <br />under federal statute. The language is to insure that there is no interfere with the maintenance of <br />the tower. <br /> <br />Section 9.15.05(a): Mr. Alexander requested the one-mile search radius be changed to one-half <br />mile. A radius beyond one-half mile is meaningless because each tower can only be moved within <br />its cell one-half mile in any direction. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Holland to change the radius <br />reference in Section 9.15.05(a) to one-half mile. <br /> <br />Planning Commission/February 4, 1997 <br /> Page 11 of 15 <br /> <br /> <br />
