Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, <br />Deemer, LaDue, Terry and Thorud. <br /> <br />Section 9.15.19: Mr. Alexander requested that an additional provision to exempt radio <br />frequencies from local electrical standards, as they must comply with federal regulations. <br /> <br />Motion by Commissioner Holland, seconded by Commissioner Deemer to add 9.15.19 (a) to <br />exempt radio frequencies from local electrical standards, as they must comply with federal <br />regulations. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, Jensen, <br />LaDue, Terry and Thorud. <br /> <br />Mr. Alexander requested that a final paragraph be added to the ordinance to grandfather provision <br />for existing towers as of a certain date to continue to operate under the existing height <br />dimensions. If the existing tower should be destroyed by natural disaster and can be <br />reconstructed, which is cheaper than building a new tower, that the reconstruction not have to <br />comply with the City ordinance. <br /> <br />It was the consensus of the Commission to not adopt this provision. <br /> <br />Mr. Alexander asked to what extent the tower would have to be damaged before it would have to <br />be replaced with a new pole that conforms to City ordinance. <br /> <br />Zoning Administrator Frolik answered that if 50 percent of the value or more has to be replaced, <br />the structure would have to conform to City ordinance. <br /> <br />Mr. Alexander requested an additional provision stipulating that if less than 50 percent of the <br />value of the tower has to be replaced, the structure can remain as a pre-existing use and not be <br />required to conform to City ordinance. <br /> <br />It was the consensus of the Commission to not add a specific provision regarding reconstruction <br />ora damaged tower as a pre-existing non-conforming structure. <br /> <br />Motion by Commissioner Holland, seconded by Commissioner Jensen to amend the proposed <br />ordinance in accordance with the above discussion and motions and direct staffto prepare it for a <br />public heating. <br /> <br />Motion carried.
