Commissioner Jensen inquired about development time lines of Apple Ridge and Sunflower Ridge. <br />Mr. Peterson responded development of both subdivisions would coincide if at all possible. He added <br />development of Apple Ridge would be a higher priority. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry recommending that the <br />developer proceed to apply for preliminary plat approval of Sunflower Ridge contingent upon <br />compliance with City Staff.Review Letter dated March 27, 1997, and obtaining the proper zoning. <br />And if major changes occur, the item should be brought back to the Commission for further review <br />and corresponding consideration. <br /> <br />Motion Carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Holland, and <br />Jensen. Voting No: None. Absent: Commissioners LaDue and Thorud. <br /> <br />Case tt8: Proposed Ordinance to Establish Regulations for Towers and Antennas <br /> <br />The Planning Intern presented Commission members with an updated version of the proposed <br />ordinance reflecting previously discussed changes at the February 4 and April 1, 1997, Planning <br />Commission meetings. <br /> <br />Mr. Tom Alexander, representing American Portable Telecom, was present to address the <br />Commission regarding his concern over the inappropriateness of the sections in Ramsey's proposed <br />towers ordinance which require professional engineering certification for issues related to frequency <br />(sections 915.05 (a)(2) and (a)(3)). <br /> <br />Commissioner Bawden confirmed that based on previous discussion, wording has been changed to <br />"licensed radio technician" versus "radio frequency engineer." Commissioner Deemer added <br />connotations of"engineer" could limit some people from servicing a tower simply because they are <br />not an "engineer" despite their qualifications. After clarification, Mr. Alexander agreed with <br />Commissioner Deemer's point. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that the City <br />Council consider the proposed amended ordinance to amend Chapter 9 of the City Code which will <br />establish regulatory controls on the siting of antennas and towers. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Holland, and <br />Jensen. Voting No: None. Absent: Commissioners LaDue and Thorud. <br /> <br />Case 119: Zoning Bulletin and Zoning News <br /> <br />Commissioner Deemer encouraged notation of pig farms despite the absence of any in Ramsey. <br /> <br />Commissioner Deemer noted page 73, "When an ordinance was ambiguous, a court interpreted its <br />language in favor of the property owner; in this case, BP."
