<br />Councilmember Dehen stated that he is not familiar with the background of this situation, but <br />feels the City has a better use for $50,000. He suggested that the three property owners go <br />through legal mediation to resolve the issue and get a judicial determination of the boundaries. <br /> <br />Public Works Director Olson gave a brief history of the background with the property owners in <br />this situation. He stated that basically it is a private driveway on a public road. <br /> <br />Councilmember Olson asked about the costs for widening the streets, removing the trees and <br />getting it to City standards, but not paving it. <br /> <br />City Administrator Ulrich suggested that the City could also post No Parking signs to resolve the <br />problem they are currently having, so there is still access, just no parking. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Dehen, to recommend to the <br />City Council that the City not move forward with plans to pave 160tl1 Lane Extension, but to <br />clear the trees to the right of way and post No Parking signs. <br /> <br />Motion carried. Voting Yes: Councilmembers Olson and Dehen. Voting No: None. Abstain: <br />Chairperson Elvig' , <br /> <br />Case #5: <br /> <br />Discuss Now and Then Estates Streets <br /> <br />Public Works Director Olson stated that a meeting was held on Wednesday, August 8, 2007 to <br />hear from the property owners in this subdivision on how the issues of sewer and Water <br />extensions and/or street reconstruction should be addressed. Ten residents representing seven of <br />the twelve properties fronting on the two subdivision streets, which are in poor condition, Garnet <br />Street and 166th Avenue attended the meeting. The main focus of the discussion centered on <br />whether if the street should be reconstructed without installing sanitary utilities. Staff pointed out <br />that based upon recent feasibility studies prepared for Ramsey Boulevard and Isih Lane the cost <br />of installing sewer and water and replacing the street would be in the range of $300 per foot. He <br />stated that it was the general consensus of those in attendance that the street should be repaired <br />until sewer and water is extended into the area. <br /> <br />Motion by Chair Elvig, seconded by Councilmember Olson, to recommend that the City Council <br />direc~ the Public Works department to continue with repairs for the streets within Now and Then <br />Estates, until sewer and water is extended, at which time the roads can be reconstructed to <br />current standards. <br /> <br />Further Discussion: Councilmember Dehen asked if it was the City's policy to do an overlay or <br />construct a new road in this kind of situation. Public Works Director Olson stated that generally <br />the City would overlay this type of project, however, this project is a bit different because two <br />years ago, 10 of the 12 property owners had purchase agreements with John Peterson to sell their <br />property. He stated that the market has changed and 'property owners do not want to put a <br />significant amount of money into the road that will just be tore up before utilities can be <br />included. Chair Elvig stated that this is not something the City decided on their own, but with <br />input from the residents who live on the road. <br /> <br />Public Works Committee / September18, 2007 <br />Page 19 of 23 <br />
