<br />CASE # t.j <br /> <br />CONSIDER REQUEST FROM OAKWOOD LAND DEVELOPMENT INC. <br />REGARDING BROOKFIELD TRAIL REIMBURSEMENT <br />By: Steven Jankowski, City Engineer <br /> <br />Background: <br /> <br />Attached is a letter from Mr. John Peterson requesting reimbursement for the installation <br />of trail associated with the Brookfield development. This letter includes a detailed <br />breakdown of the actual cost incurred for the installation of the trail and a section of the <br />development agreement signed on Iuly 20,2006. Staff concurs that Oakwood is entitled for reimbursement for <br />the length of the trail stated in the letter. The development agreement acknowledged that <br />the entire length ofthe Trott Brook trail and the trail along CSAH 5 from the southern <br />boundary ofthe Brookfield plat to 16ih Avenue would be reimbursed at the unit price of <br />$14.09 per foot. This unit price was based upon an estimate provided by the developer's <br />engmeer. <br /> <br />Observations: <br /> <br />The difference between the requested reimbursement and that anticipated by the <br />development agreement is $80,615.05, an increase of92% over the anticipated payment <br />amount. It has been past practice of the City to limit reimbursement for trail based upon <br />the unit price identified in the development agreement. Oakwood points out that the <br />Brookfield development will generate a total of $730,01 0 when the subdivision is <br />completed. <br /> <br />Recommendation: <br /> <br />Although it is important to abide by the conditions established within development <br />agreements, City staff would acknowledge that the anticipated costs for the construction <br /> <br />17 <br />
