<br />SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />15. Requirements forBuilding and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure; (b) a Certificate of Survey, including that survey information required by the CITY <br />has been supplied to the City Building Official; (c) all the financial guarantees required by the <br />CITY have been satisfied; and (d) this Development Agreement has been signed and <br />received by the CITY. Only 4 (four) building permits shall be issued until such time that the <br />water system is fully functional and has been looped betweenVariolite St. and CSAH 5. All <br />foundation approvals will require a certificate of elevation verifying that the actual elevation <br />is in compliance with the approved grading and drainage plan. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) <br />both the sanitary sewer and water utilities are in place, fully operational, and accepted by the <br />CITY; (c) for lots that have a slope of less than 2%, a certificate of grading, prepared bya <br />licensed (State of Minnesota),. professional land surveyor, must be provided to the. City <br />documenting that the flattest grade on this lot is 1 % or greater will require certificates of <br />grading; (d) boulevard sod and landscape trees, or escrow for same, have been provided (see <br />Paragraph 19 below); and (e) the water system has been looped and is fully functional <br />between Variolite St. and CSAH 5. <br /> <br />SECTION IV <br />P ARK DEDICATION <br /> <br />16. Park Dedication. The Brookfield Plat is located in the Trott Brook Recreation District. <br />Park dedication requirements shall be satisfied by a cash payment of Two Thousand Four <br />Hundred Dollars and no cents ($2,400.00) per lot. The two existing homesteads located <br />within the plat are exempt from the park dedication requirement. The cash payment due on <br />the Plat is One Hundred Seventy Thousand Four Hundred Dollars and no cents <br />($170,400.00) (71 lots x $2,400/lot). This payment shall be made to the City prior to the. <br />release of the Final Plat for recording. These monies, together with the available Trail Fees <br />(Paragraph #17) shall be available for construction of a ten-foot wide bituminous trail parallel <br />to Trott Brook within the CITY'S conservation and trail easement. The cost of the <br />construction of this trail is $14.09 per lineal foot. <br /> <br />SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />17. Trail Development and Fees. The CITY'S Trail Development Fee is Five Hundred Eighty <br />Dollars and no cents ($580.00) per unit. The 2 existing homesteads located within the plat are <br />exempt from this fee requirement.
