<br />Thousand One Hundred Eighty Dollars and no cents ($41,180.00) (71 lots x $580.00/10t) <br />shall be paid to the CITY prior tQ releasing the Plat for recording. In addition to the Trott <br />Brook trail referenced in Paragraph 17, a trail is also required to be constructed from the <br />intersection of the Trott Brook trail and CS~H 5, south to 16th Avenue. The CITY shall <br />reimburse the developer at a unit price of$14.09 per lineal foot for the length of trail <br />constructed outside the limits of the Plat. The reimbursement shall be processed after the trail <br />is inspected and accepted by the CITY. <br /> <br />18. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITY, not to exceed 5%. Sidewalk construction will occur along 170th <br />Avenue, 170th Trail 1~9th Lane, Gamet Street and Feldspar Street. The costs associated with <br />sidewalk construction are not eligible as a credit towards the Trail Development Fees and/or <br />Park Dedication requirements due on the Plat. <br /> <br />19. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall <br />be in accordance with the approved Landscape Plan and Tree Inventory prepared by Passe <br />Engineering, dated April 6, revised April 21, 2006, revised May 2, 2006, revised June 30, <br />2006, revised July 6, 2006, revised July 10, 2006, revised . The trees <br />to be protected during construction must be identified on the grading plan, and the plan must <br />require the installation of 'tree save fences' prior to land clearing or grading. The approved <br />. Plan generally requires 2 trees per lot, with the exception of the following lots which require <br />additional landscaping for density transition purposes: <br /> <br />Lots 1,8,9, and 12, Block 1 <br />Lots 1,8,9, 10, 11, and 12, Block 2 <br />Lots 1 and 8, Block 4 <br />Lots 1,5, and 6, Block 5 <br />Outlot F <br /> <br />All required landscaping must be in place prior to the release of a Certificate of Occupancy <br />for all lots in the plat, or a surety for same must be deposited with the Building Department. <br /> <br />In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: <br /> <br />a) Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />24 <br /> <br />b) For trees intended to be planted between the sidewalk and the street, the specific <br />locations must be staked in advance of planting and approved by the CITY. I~ the <br />event the weather is not conducive to tree or planting; sod in the boulevard at the time <br />of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in <br />the amount of $300.00 for trees and $300.00 for sod in an escrow account with the <br />CITY and upon verification of the planting being accomplished, said cash deposit <br />Brookfield First Addition <br />Development Agreement <br />Page 9 of 13 <br />
