Thousand One Hundred Eighty Dollars and no cents ($41,180.00) (71 lots x $580.00/10t) shall be paid to the CITY prior tQ releasing the Plat for recording. In addition to the Trott Brook trail referenced in Paragraph 17, a trail is also required to be constructed from the intersection of the Trott Brook trail and CS~H 5, south to 16th Avenue. The CITY shall reimburse the developer at a unit price of$14.09 per lineal foot for the length of trail constructed outside the limits of the Plat. The reimbursement shall be processed after the trail is inspected and accepted by the CITY. 18. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations prescribed by the CITY, not to exceed 5%. Sidewalk construction will occur along 170th Avenue, 170th Trail 1~9th Lane, Gamet Street and Feldspar Street. The costs associated with sidewalk construction are not eligible as a credit towards the Trail Development Fees and/or Park Dedication requirements due on the Plat. 19. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall be in accordance with the approved Landscape Plan and Tree Inventory prepared by Passe Engineering, dated April 6, revised April 21, 2006, revised May 2, 2006, revised June 30, 2006, revised July 6, 2006, revised July 10, 2006, revised . The trees to be protected during construction must be identified on the grading plan, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. The approved . Plan generally requires 2 trees per lot, with the exception of the following lots which require additional landscaping for density transition purposes: Lots 1,8,9, and 12, Block 1 Lots 1,8,9, 10, 11, and 12, Block 2 Lots 1 and 8, Block 4 Lots 1,5, and 6, Block 5 Outlot F All required landscaping must be in place prior to the release of a Certificate of Occupancy for all lots in the plat, or a surety for same must be deposited with the Building Department. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: a) Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). 24 b) For trees intended to be planted between the sidewalk and the street, the specific locations must be staked in advance of planting and approved by the CITY.
