<br />Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-09-208 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0806 RELATING TO A REQUEST <br />FROM DONALD HASSLER FOR A VARIANCE TO CONSTRUCT AN ACCESSORY <br />STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL <br />STRUCTURE <br /> <br />WHEREAS, Donald Hassler, hereinafter referred to as "Applicant," has properly applied <br />for a variance from Section 9.11.02 (Accessory Structures) of the Ramsey City Code to construct <br />an accessory structure nearer the front property line than the principal structure on the property <br />generally known as 6660 Bih Avenue NW and legally described as follows: <br /> <br />Lot 16, Auditors Subdivision No. 30, except that part platted as Riverside West, Subject <br />to easement of record, Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF' ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.07 of the Ramsey City Code on September 6, 2007, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 MUSA and is approximately 0.7 acre in size. <br /> <br />3. That the Subject Property is surrounded by properties also zoned R-1 MUSA. <br /> <br />4. That the Subject property is a riparian lot on the Mississippi River and is located in the <br />Critical River Overlay District. <br /> <br />5. That Ramsey City Code Section 9.11.02 does not permit the construction of accessory <br />buildings nearer the front property line than the principal building on lots less than two (2) <br />acresm SIze. <br /> <br />6. That Section 9.21.07 (Critical River Overlay District Development Standards) of City Code <br />establishes a structure setback of 100 feet from the Ordinary High Water (OHW) mark of <br />the Mississippi River or twenty (20) feet from the bluff line, whichever is greater. <br /> <br />7. That the principal structure on the Subject Property is located approximately 75 feet from <br />the OHW mark of the Mississippi River and is considered lawful nonconforming. <br />
