That the Applicant is proposing to construct a 26' x 26' accessory structure on the Subject <br />Property that will be approximately 30 feet from the front property line and about 126 feet <br />from the OHW mark of the Mississippi River. <br /> <br />9. That the new accessory structure is to replace an existing garage that burned several years <br />ago, that is also closer to the front property line than the home. <br /> <br />10. That the proposed accessory building will be approximately 10 feet from the nearest side <br />property line. <br /> <br />11. That the total square footage of accessory buildings on the Subject Property, including the <br />proposed building, will comply with the maximum allowable square footage in City Code. <br /> <br />12. That the proposed .accessory building will comply with the height regulations outlined in <br />City Code. <br /> <br />13. That the accessory building will be finished with vinyl siding, soffit, and fascia to <br />complement the home. <br /> <br />14. That there are three additional non-conforming accessory structures on the Subject <br />Property: a small garden shed and two plastic tent structures, one of which is being used for <br />storage and one as a carport. All three are closer to the front property line than the house. <br /> <br />15. That the proposed accessory building will be well screened from adjacent properties and the <br />river by existing trees. <br /> <br />16. That similar variances have been granted in the R-1 MUSA District in the City of Ramsey. <br /> <br />17. That the Mississippi River setback requirement imposes a hardship on the Subject Property <br />that is not applicable to other non-riparian lots in the same district. <br /> <br />18. That, if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />19. That, if granted, the variance will not have the effect of allowing a use that is prohibited in <br />the applicable zoning district. <br /> <br />20. That, if granted, the variance will not increase the congestion on the public street. <br /> <br />21. That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br /> <br />22.
