Councilmember introduced the following resolution and moved for its adoption: RESOLUTION 907 -10- A RESOLUTION APPROVING THE ISSUANCE OF A HOME OCCUPATION PERMIT TO ESTABLISH AND OPERATE A BED AND BREAKFAST ON THE PROPERTY LOCATED AT 7822 142 AVE NW, BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT WHEREAS, the Ramsey City Council adopted Resolution #07 -_ -_ adopting Findings of Fact # for this use and herein approves the Home Occupation Permit. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 2007 a Home Occupation Permit ( "Permit ") was issued by the City of Ramsey ( "City ") to Mary Toso ( "Permit Holder ") for a home occupation to establish a bed and breakfast within the principal dwelling on the property generally known as 7822 142 Ave NW and legally described as follows: Lot 8, Block. 3 Alpaca Estates 2 nd Addition, Anoka County, Minnesota, subject to easement as shown on plat ( "Subject Property: ") This permit is issued pursuant to Section 9.03.05 and 9.11.04 of the Ramsey City Code. The conditions of this permit are as follows: 1. That this resolution shall allow for the establishment and operation of a bed and breakfast within the principal dwelling located on the Subject Property. 2. Should the Permittee die or move to a new location, the Permit shall be automatically terminated, except that in the case of death, should a surviving spouse or child, residing at the same address, desire to continue the home occupation, written notice to that effect shall be given to the City Administrator and the City Council may authorize continuation of the Permit without further hearing. 3. The area devoted to the home occupation shall not exceed twenty percent (20 %) of the total floor area of the private dwelling. 4. Adequate off - street parking shall be provided by the Permit Holder. 5. No more than 4 (four) guests may occupy the bed and breakfast at one time. 6. One sign (no larger than 3 square feet) is allowed at the end of the Permitee's driveway. -112-
