CASE #: REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT SOILS; CASE OF ERIC THOMSEN By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik 7 Background: On January 14, 1997, the City received an application from Eric Thomsen to grade and export soils from an area generally located west of T.H.//47 and south of County Road #63, at about Vanadium Street N.W. The subject property consists of 9 acres. The following items are enclosed for your information: a) b) c) d) e) Site location map Revised Grading Plan dated March 17, 1997 and accompanying letter dated January 14, 1997 Planning Commission meeting minutes dated February 4, 1997 Letter from Anoka County dated March 4,1997 Proposed findings of fact Proposed conditional use permit Notification: Conditional Use Permits are required to be subjected to public hearings with all properties within 350 feet being notified of the public hearing. In this case, Staff attempted to notify all property owners within 500 feet of the subject property. The Anoka County Highway Department was also notified of the conditional use permit application. Observations: The Grading Plan requests approval for the removal of 200,000 cubic yards of materials from an area of approximately 9 acres. The application requested the duration of the permit to be for a 5 year period. The operation will occur in two phases. Topsoil will be stripped off of the Phase I area and will be deposited in a four foot high berm along the south and east perimeter of the excavation site. This berm will be seeded to prevent erosion during the mining activity. Silt fence will be placed between the berm and adjacent wetland area. No grading will occur in the wetland. Twenty-one coniferous trees and 7 hardwood trees will be removed to facilitate the grading according to the plan. A sequencing plan regulates the removal of material from north to south in quarter acre sections.
