preliminary plat approval, however, the City can grant a timed extension to the applicant. On <br />September 20, 2006, the developer requested an extension until October 25, 2007, which the City <br />Council granted. She stated that on September 20, 2007, the City received another request from <br />the developer for another one-year extension. She stated that the reason given by the developer <br />is the uncertainty in the market. <br />Councilmember Dehen stated that this cycle of extensions could go on for years and asked what <br />negative impact this could have on the City other than the fact that architectural standards may <br />change. He asked if the City Council denied this request for an extension whether the developer <br />would need to come back in with upgraded architectural standards. <br />Associate Planner Geisler stated that if the City Council did deny this request the developer <br />would need to come back with upgraded architectural standards. She stated that staff has looked <br />at whether the standards have changed significantly since the original preliminary plat approval <br />and found that they had not. She stated that staff is recommending that this extension be <br />approved, but not recommending any additional extensions be granted after the 2008 <br />comprehensive plan goes into effect. <br />Motion by Councilmember Olson, seconded by Councilmember Elvig, to adopt Resolution #07- <br />10-292 granting a one year extension to Summerset Meadows LLC to submit the final plat for <br />the Summerset Meadows subdivision. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Olson, Elvig, Dehen, and Look. <br />Voting No: None. Absent: Councilmembers Jeffrey and Strommen. <br />Case #5: Adopt Ordinance Declaring Land as Surplus for Property and Authorizing <br />the Sale. of Lot 5, Block 4, Gateway North Industrial Park Plat 2 <br />Economic Development Coordinator Sullivan stated that the City Council had introduced an <br />ordinance on October 9, 2007 to declare this property surplus and authorize its sale. <br />Councilmember Dehen stated that in the ordinance it states that the Council has determined the <br />consideration and terms upon which the above described property may be sold. He stated that he <br />does not recall seeing any terms for the sale. <br />Economic Development Coordinator Sullivan stated that once the ordinance is adopted, it will be <br />published fora 30 day period, then staff can negotiate the deal and bring the terms back the City <br />Council. <br />City Attorney Goodrich stated that Section 3 of the ordinance could be removed. <br />Councilmember Dehen asked if there was anything saying that the City needed to move the <br />property within a certain amount of time. He stated that there is a depressed market right now, so <br />he would like to hang onto the property until there is a rebound in the market. <br />City Administrator Ulrich stated that if the ordinance is approved, it does not obligate the City to <br />sell this property in a certain amount of time, so the City can wait for the market price to be <br />City Council /October 23, 2007 <br />Page 12 of 21 <br />
