Commissioner Deemer recalled that he has mentioned trimming the trees when acquiring the right- <br />of-way at 153rd Avenue and T.H. #47. He reiterated that this is a real sight hazard and stressed <br />the importance of doing this as soon as possible, not waiting until the commercial property is <br />developed. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to accept #1 through <br />g9 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, LaDue, <br />Terry, and Thomd. Voting No: None. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Deemer to amend #10 to read <br />"That the proposed zoning amendment will not substantially adversely impair the use or market <br />value of any surrounding property." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, LaDue, <br />Terry, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Deemer to amend #11 to read <br />"That the proposed zoning amendment will not change the essential character of the area." <br /> <br />Further Discussion: Commissioner Thorud wondered how you can not change the character if <br />you're changing the use (changing from Business to Residential). Commissioner Holland replied <br />it's not being used as business. Commissioner Deemer suggested that Staff reword this particular <br />finding in the future to avoid this confusion. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, LaDue, and <br />Terry. Voting No: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the amended Findings of Fact relating to a request from Blaine Edmundson to <br />rezone certain property from B-1 Business to R-1 Urban Residential. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, LaDue, <br />Terry, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council approve the request from Blaine Edmundson to rezone a portion of the proposed plat of <br />Brandseth to R-1 Urban Residential. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, LaDue, <br />Terry, and Thomd. Voting No: None. <br /> <br />Ms. Frolik advised that she has been contacted by United Power Association, who has a substation <br />located adjacent to Brandseth, and they would like prior notification of any construction on the <br />property. <br /> <br />Case #2: <br /> <br />Request for Site Plan Approval of Bank Facility; Case of Riverside <br />Development <br /> <br />Zoning Administrator Frolik reported Riverside Development has applied for site plan approval of <br />a bank facility to be constructed on Lots 3 and 4, Block 1, River's Bend Plaza 3rd Addition.
