<br />Ms. Frolik went on to address the issue of licensing by other regulatory agencies. She advised that
<br />the applicant has registered with the MPCA, and their review staff has until Thursday, April 4, to
<br />respond to the application. If there are no concerns, they will issue a license within 3-5 days. She
<br />noted that Anoka County Environmental Services are not through with their review.
<br />
<br />Commissioner Deemer inquired whether Ms. Frolik felt the applicant would comply with these
<br />agencies.
<br />
<br />Ms. Frolik replied "He does what he has to."
<br />
<br />The Planning Commission proceeded to review the Findings of Fact.

<br />Motion by Commissioner Deemer and seconded by Commissioner Holland to accept #1 through
<br />g9 as presented.

<br />Motion by Commissioner Holland and seconded by Commissioner Deemer to amend #10 to read
<br />"That the proposed use will not substantially adversely impair the use, enjoyment or market value
<br />of any surrounding property."

<br />Further Discussion: Commissioner Deemer noted that no one has objected to this request, and the
<br />City owns the property immediately adjacent.

<br />"That the proposed use will not create excessive additional requirements at public cost for public
<br />facilities and services."

<br />Holland, LaDue, and Thomd. Voting No: None.

<br />Motion by Commissioner Thomd and seconded by Commissioner Holland to amend #12 to read
<br />"That the proposed use will not involve uses, activities, processes, materials and equipment and
<br />conditions of operation that will be detrimental to persons, property or the general welfare by
<br />reason of excessive production of glare, noise, traffic, smoke, fumes or odor."
<br />
<br />Further Discussion: Commissioner Thorud noted that the key word is "excessive."

<br />Amendment by Commissioner Deemer and seconded by Commissioner Terry that the wording be
<br />changed to read "That as proposed, the use will not involve uses, activities .... "
