Commissioner Thorud also pointed out that #14 addresses reports generated from the subject <br />property by the Ramsey Police Department. <br /> <br />Mr. McLafferty again stated that most of those calls were generated by himself because "I don't <br />take chances." He stated that he has gone years without any complaints, however, he is now more <br />vigilant. He did note that there have not been any calls since January of this year. <br /> <br />Commissioner Jensen inquired about the juvenile sex offender registration. <br /> <br />Ms. Frolik explained that the police department must be notified, however, not the neighbors when <br />it's a juvenile. <br /> <br />Commissioner Deemer inquired if Mr. McLafferty could answer questions regarding the sex <br />offender, off camera. <br /> <br />Mr. McLafferty responded that he could not; the court system would shut him down in a minute if <br />he violated the privacy of a juvenile. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner LaDue to amend #15 to read <br />"That the addition of two youth at the residence will not be unduly dangerous or otherwise <br />detrimental to neighboring residences." <br /> <br />Motion carried. Voting Yes: Commissioners Holland, LaDue, Jensen, and Terry. Voting No: <br />Chairperson Deemer and Commissioner Thorud. Absent: Chairperson Bawden. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner LaDue to amend #16 to read <br />"That the addition of two youth at the residence will not substantially adversely impair the use, <br />enjoyment or market value of any surrounding property." <br /> <br />Motion carried. Voting Yes: Commissioners Holland, LaDue, Jensen, and Terry. Voting No: <br />Chairperson Deemer and Commissioner Thorud. Absent: Chairperson Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend #17 to read <br />"That the addition of two youth at the residence will be operated and maintained so as to be <br />harmonious and appropriate in appearance with the existing or intended character of the general <br />vicinity and the addition of two youth at the residence will change the essential character of the <br />area." <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Commissioners Thorud, Holland, Jensen, and <br />LaDue. Voting No: Commissioner Terry. Absent: Chairperson Bawden. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Jensen to amend #18 to read <br />"That the addition of two youth at the residence will not be hazardous or disturbing to existing or <br />future neighboring uses." <br /> <br />Further Discussion: Commissioner Thorud commented they heard tonight from quite a few <br />neighbors who did find this disturbing to them. Commissioner Holland noted the finding was for <br />"neighboring uses" not neighbors. Commissioner Deemer felt the finding should be separated into <br />two findings; he didn't believe it was hazardous but definitely disturbing. Commissioner Jensen <br />stated that just because one finds it disturbing personally, doesn't mean it's disturbing to uses. <br />Commissioner Thomd responded that the "neighboring uses" is residential homes. <br /> <br />Amendment by Chairperson Deemer and seconded by Commissioner Thorud to separate #18 into <br />two findings which would address separately "hazardous" and "disturbing". <br /> <br />Amendment failed. Voting Yes: Chairperson Deemer and Commissioner Thorud. Voting No: <br />Commissioners Holland, Jensen, LaDue, and Terry.
