Absent: Chairperson Bawden. <br /> <br />Case #4: <br /> <br />Request for Conditional Use Permit for a Group Foster Care Home; <br />Case of Patrick McLafferty <br /> <br />Refer to the public hearing minutes for information regarding the review of the Findings of Fact <br />and terms of the permit. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Terry to recommend that City <br />Council approve Patrick McLafferty's request for a conditional use permit and adopt the resolution <br />declaring terms of same, as amended. <br /> <br />Further Discussion: Commissioner Thorud disagreed with some of the Findings of Fact and some <br />of the terms. Chairperson Deemer stated he felt all group homes and daycares should be required <br />to have occupation permits. <br /> <br />Motion carded. Voting Yes: Commissioners Holland, Terry, Jensen, and LaDue. Voting No: <br />Chairperson Deemer and Commissioner Thom& Absent: Chairperson Bawden. <br /> <br />As a final comment, Mr. McLafferty, wondering how much this has cost the taxpayers in Ramsey, <br />stated that while the City was busy investigating ways to get rid of his foster home, the daughter of <br />the woman living to the rear of his property was prosecuted for 34 counts of child abuse and <br />molestation, receiving 166 months in prison. <br /> <br />Case #5: Request for Sketch Plan Approval of Old Schoolhouse No. 28 <br /> Addition; Case of City of Ramsey <br /> <br />Zoning Administrator Frolik reported that the City requests sketch plan approval of a minor <br />subdivision to plat the former public works site into two parcels, thereby separating the existing <br />old school house/town hall and the newly approved bank facility. The property is zoned B-1 <br />Business, and both lots meet the 1/2 acre minimum lot size. Both lots also meet the minimum lot <br />depth requirement of 150 feet. Both lots front on T.H. #47 but will receive access from a private <br />road extension off of 142nd Avenue. When the site plan for the bank was reviewed, MnDOT <br />stated a need for an additional 12 feet of right-of-way along T.H. 4/47 to create a 45 foot wide <br />right-of-way on the west side of the centerline; the proposed plat accommodates that request. In <br />addition, it was discovered that 142nd Avenue crossed the northwest comer of the subject property <br />and that segment of the street was not officially dedicated as a public street; the proposed plat also <br />corrects that situation. City Staff recommends approval of the sketch plan. <br /> <br />City Engineer Jankowski stated the total right-of-way for T.H. #47 at this location will be 120 feet. <br /> <br />Ms. Frolik noted that Lot 1 is the bank facility and Lot 2 is the old school house/town hall. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to approve the sketch <br />plan for Old School House No. 28 Addition subject to items in the Staff Review Letter dated April <br />25, 1996. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Commissioners LaDue, Holland, Jensen, <br />Terry, and Thorud. Voting No: None.
