Motion by Commissioner LaDue and seconded by Commissioner Holland to amend #9 to read <br />"That the proposed zoning amendment will not substantially adversely impair the use or market <br />value of any surrounding property." and #10 to read "That the proposed zoning amendment will <br />not change the essential character of the area." <br /> <br />Motion carried. Absent: Chairperson Bawden. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Thorud to recommend that City <br />Council approve the request from Ann Moroz to rezone Lots 6 and 7, Block 1, Golden Eagle <br />Estates, to R- 1 Rural Residential and recommending that access be off of Willemite Street. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Commissioners Holland, Thomd, Jensen, <br />LaDue, and Terry. Voting No: None. Absent: Chairperson Bawden. <br /> <br />Case #3: <br /> <br />Request for Preliminary Plat Approval of Rabbit Run; Case of Jon <br />Rambosek, S.L. Dream Homes <br /> <br />Zoning Administrator Frolik stated that Jon Rambosek requests preliminary plat approval to <br />subdivide 40 acres in the rural residential district into 4 single family lots. The subject property is <br />located on the south side of 167th Avenue, west of the Rum River Plaza Shopping Center. The <br />plat is in conformance with 4 in 40 density zoning. Three lots will have access to a cul-de-sac <br />extending south of 167th, and the fourth lot will have direct access onto 167th. The cul-de-sac <br />does not exceed the 600 foot maximum length restriction. A resubdivision plan has been submitted <br />indicating that the proposed plat design and building pad locations will not hinder resubdivision of <br />the property if and when sewer and water becomes available to the site. Wetlands are in the <br />process of being delineated; all wetlands should be dedicated as drainage and utility easements on <br />the final plat. Soil borings have been provided that show shallow depth to mottled soils. Mound <br />type septic systems are likely on these lots, however, adequate areas for replacement mounds <br />appear to be available. <br /> <br />City Engineer Jankowski reviewed the grading and drainage plan as outlined in City Staff Review <br />Letter dated April 24, 1996. <br /> <br />Ms Frolik added that the Park Commission has recommended park dedication be satisfied with a <br />cash payment. They have also requested that the resubdivision plan provide an access to the park <br />immediately south of the plat. City Staff recommends preliminary plat approval. <br /> <br />Commissioner Thorud inquired whether there would be some land easement set aside for the <br />streets. <br /> <br />Mr. Jankowski replied that there was more than one way of subdividing, and there really was no <br />need since the resubdivision won't occur until the MUSA is expanded. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Thomd to recommend that City <br />Council approve the proposed preliminary plat for Rabbit Run based on discussion and contingent <br />upon compliance with City Staff Review Letter dated April 24, 1996. <br /> <br />Planning Commission/May 7, 1996 <br /> Page 3 of 5 <br /> <br /> <br />
