Case #3: <br /> <br />Request for a Conditional Use Permit to Export Soils; Case of Edson <br />Investment Family Limited Partnership <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to accept #1 <br />through//9 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, <br />Holland, Jensen, Terry, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to modify #10 <br />through # 16 in the affmnative. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Jensen, LaDue, Terry, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Terry to recommend the <br />City Council adopt the Findings of Fact as amended. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Holland, Terry, Deemer, <br />Jensen, LaDue, and Thorud. Voting No: None. <br /> <br />The Planning Commission proceeded to review the CUP. <br /> <br />Commissioner Deemer asked about term #10 of the Conditional Use Permit, and if there will <br />be stockpiling. Mr. Jankowski stated that this would be a situation where materials would <br />be stockpiled and then removed. Blaine Edmundson, representing Edson Investment Family <br />Limited Parmership, stated that there is currently a stockpile situation. <br /> <br />Commissioner Deemer asked how term # 10 of the Conditional Use Permit would apply and <br />added that many times stockpiles tend to slide down on their own. Mr. Jankowski asked how <br />high the piles were. Mr. Edmundson stated that the sand is approximately seven feet high <br />and the topsoil is approximately six to seven feet high with the backside sloped and the side <br />facing Highway #47 slopes rather abruptly at this time. <br /> <br />Commissioner Deemer stated that sloping stockpiles everyday is not workable and suggested <br />that term//10 be eliminated. Mr. Jankowski stated that they require some type of safety <br />fence. Commissioner Deemer stated that a safety fence would serve as a warning. Mr. <br />Jankowski asked Mr. Edmundson how he felt about using safety fencing. Mr. Edmundson <br />stated that in the past it has not worked for him. Mr. Edmundson explained that he would <br />rather keep close track of the stockpiles and try to keep it sloped. He stated that the sand will <br />be moved out in large quantifies and the topsoil will move slower.
