Case #4: Zoning Bulletin and Zoning News <br /> <br />Chairperson Bawden noted the Zoning Bulletin and Zoning News information. <br /> <br />Case #5: Approve Amendment to Chapter 8 (Building and Housing of the City Code) <br /> <br />Zoning Administrator Sylvia Frolik stated the purpose of the amendment at hand is to place a time <br />limit on finishing the exterior of a construction project, thus ensuring aesthetic completion of a project <br />in a timely manner. The maximum time allowed would be twelve months for completion of exterior <br />finish. <br /> <br />In response to Commissioner Jensen, all exterior work would need to be finished which includes <br />doors, windows, etc. <br /> <br />Commissioner Deemer inquired about the penalty section of the amendment, specifically referring to <br />the financial penalties. Upon further discussion, the consensus was to not call out a dollar figure in <br />the ordinance and defer to the amount set by the courts. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to amend Number Two <br />under the Penalty section, paragraph two to read "Any person violating any provision of this section <br />is guilty of a misdemeanor and upon conviction shall be punished by a fine and/or imprisonment." <br /> <br />Motion Carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Jensen, LaDue, <br />Terry, and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend Council <br />adoption of the proposed amendment to place a time limit on finishing the exterior of a construction <br />project. <br /> <br />Motion Carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Jensen, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />COMMISSION INPUT <br /> <br />Chairperson Bawden informed the Commission he has met with the Building Inspector regarding <br />sewer/septic systems. Work is still being done to address potential issues associated with a proposed <br />ordinance. At this point it appears in the best interest of the City to adopt the State statutes and then <br />follow up with an ordinance. A proposed ordinance would need to be submitted to the State by <br />January, 1998. <br /> <br />Commissioner Thorud inquired whether a person selling his/her property would be required to bring <br />the sewer/septic system up to code.
