Mayor Hardin commented that the Council has not had the opportunity to review the applications. <br /> <br />Councilmember Peterson inquired if interviews would be conducted by Council or will they just <br />make a decision based on the applications. <br /> <br />Councilmember Beyer stated that she had been contacted by a resident who indicated there was a <br />mention about binding arbitration with regard to this pending lawsuit and that we could get this <br />settled more quickly. <br /> <br />City Attorney Goodrich noted that the case in discussion is the Terry Hendriksen versus the City of <br />Ramsey lawsuit. It could go to binding'arbitration if both parties agree to that. <br /> <br />Councilmemher Zimmerman suggested that would save a lot of money. <br /> <br />Councilmember Peterson felt the entire CoUncil should be involved in this appointment. <br /> <br />Councilmember Beyer questioned if this would be setting a precedence. <br /> <br />Councilmember Peterson felt it would not be'setting a precedence because this is an issue that has <br />been passed on to the Council by the Planning Commission. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Hardin to have staff schedule <br />interviews with the applicants. <br /> <br />Further discussion: Terry Hendriksen noted, that the portiOn of minutes included in the case is <br />accurate, but the discussion before that was that the Planning Commission did not feel comfortable <br />making a recommendation they would otherwise make. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson and Beahen. Voting No: <br />Councilmembers Beyer and Zimmerman. <br /> <br />Case #28: Designation of Unallocated 1995 and 1996 Community Development <br /> Block Grant (CDBG) Funds <br /> <br />Mayor Hardin announced that he would abstain from this case. <br /> <br />Zoning Administrator Frolik reported that the CDBG subcommittee is recommending that the <br />unallocated 1995 CDBG funds be designated to ACCAP for the rehabilitation of a Ramsey home <br />and that the 1996 allocation be rolled over for a possible project in 1997. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt Resolution <br />//96-02-036 designating unallocated 1995 CDBG Funds to the ACCAP Housing Rehabilitation <br />Program for specific use on a Ramsey home and rolling over the 1996 allocation for use in 1997. <br /> <br />Motion carded. Voting Yes: Councilmembers Peterson, Beyer, Beahen and Zimmerman. Voting <br />No: None. Abstain: Mayor Hardin. <br /> <br />Councilmember Zimmerman questioned why Mayor Hardin abstained from the vote to which <br />Mayor Hardin replied that he has had some business dealings with ACCAP. <br /> <br />Case #29: <br /> <br />Adopt Ordinance Authorizing the Sale of the Properties Identified as: <br />PIN's 34-32-25-14-0004 and 34-32-25-11-0007 <br /> <br />City Council/February 13, 1996 <br /> Page 26 of 32 <br /> <br /> <br />
