The public hearing adjourned at 7:11 p.m. <br /> <br />Council Business <br /> <br />Mayor Hardin called the regular portion of the City Council meeting back to order at 7:11 p.m. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Peterson to adopt <br />Resolution #96-04-069 ordering improvement and preparation of plans and specifications for <br />Improvement Project ~)6-16 (construction of sanitary sewer, watermain, storm sewer and streets <br />to Fox Knoll 2nd Addition). <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Peterson, Beahen and <br />Beyer. Voting No: None. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to adopt Resolution <br />~)6-04-070 approving plans and specifications and ordering advertisement for bids (Improvement <br />Project #96-16 sanitary sewer, watermain, storm sewer, and streets for Fox Knoll 2nd Addition). <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen, Beyer, and <br />Zimmerman. Voting No: None. <br /> <br />Case #2: Northfork Grading Permit/Andrie Street Drainage <br /> <br />Mayor Hardin announced he would abstain from discussion and voting on this case. <br /> <br />City Engineer Jankowski stated that at the July 11, 1995 meeting, City Council approved a <br />conditional use permit for the grading of four lots in the Northfork Links Addition. This permit <br />was contingent upon fulfilling a term which required that a drainage deficiency along Andrie Street <br />be solved prior to commencement of the grading. The permit had an expiration date of September <br />30, 1995. He reported that Andrie Street becomes flooded during intense rainfall periods due to <br />the lengthy distance which drainage must travel overland from Andrie Street and 153rd Avenue <br />until it reaches the first catch basin on Andrie Street. Currently this is a distance of nearly 1,800 <br />feet; the desired maximum distance is 700 feet. The North Fork engineer has proposed resolving <br />this problem with the installation of two sets of catch basins and the extension of storm sewer for a <br />distance of approximately 900 feet south of the existing catch basin on Andrie Street. Mr. <br />Jankowski stated he is of the opinion that this storm sewer will eliminate the intermittent flooding <br />problem along Andrie Street. The plan also provides for the drainage of the back yards of the lots <br />located on the west side of Andrie Street. He explained that with the drainage issue resolved, <br />construction could be completed by mid-June 1996. The issue has been raised regarding the cost <br />of the work to remediate drainage. The City's position is that the developer should have been <br />made to install these additional catch basins at the time of the original road construction. The <br />Developer's position is that installing them now represents an increased cost over installing them <br />with the construction of the street. He suggested a compromise position to resolve this would be <br />for the City to pick up the costs of bituminous removal and pavement and turf restoration. This <br />cost is estimated to be $5,000. <br /> <br />Councilmember Peterson inquired what an adequate time frame would be. <br /> <br />Dennis Peck, representing North Fork, Inc., felt they could get started when the road restrictions <br />are removed and an extension to August 1 should be sufficient. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to approve amending <br />the conditional use permit extending the grading completion date to August 1, 1996, for the <br /> <br />City Council/April 9, 1996 <br /> Page 5 of 17 <br /> <br /> <br />
