Councilmember Zimmerman felt that.the residents' fears are justified. It's difficult to get onto <br />HighWay//47. He stated he will work hard to get local initiation by 1997. If that does not happen, <br />perhaps there ai'e some avenues to be researched for a temporary fix. <br /> <br />Motion by Councilmember Peterso. n and seconded by Councilmember Beyer to grant site plan <br />approval to R.F. Development for the New-HorizonDaycare facility contingent upon compliance <br />with the City Staff review letter dated July 31, 1996. <br /> <br />Motion carrie& Voting Yes.'. Mayor Hardin, Councilmembers Peterson, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case /112: Request for Final Plat .Approval of Tranby Terrace 2nd Addition; <br /> Case 'of David .Tranby <br /> <br />Zoning Administrator Frolik stated that' David Tranby is i'equesting final'plat approval to plat 29 <br />acres in the rural service area into three lots; one existing homestead and tWo new lots. The <br />property is located' on the west side of Tiger Street, south of 173rd Avenue NW. This plat request <br />is in conformance 'with 4 in 40. density zoning. However, the minimum lot size in the Rural <br />Service Area is 10 acres and Lot 3 is proposed at 2.5 acres. Mr. Tranby's reasoning for requesting <br />the deviation from the minimum lot size is that he has a buyer for his exiting homestead On Lot 1 <br />that wants 10 acres of land. Mr. Tranby will be building himself a new home on Lot 3 and he only <br />wants the minimum lot size acceptable in the rm'al district in order to keep as much of the remainder <br />of the property as possible in tact, thus retaining more development options for the future. The <br />Planning Commission h~is recommended approval of this deviation from the minimum lot size <br />requirement on Lot 3 as the plat will remain in compliance with 4 in 40 density zoning. All lots <br />will have the required 200 feet of frontage on Tiger Street. Mr. Tranby is also planning for a <br />cooperative effort for the ultimate development of the property between the owners of Lots 2 and 3 <br />by providing an easement equal to one-half of a road right-of-way width on Lot 3. The Park and <br />Recreation Commission have recommended a cash payment to satisfy park dedication <br />requirements. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt Resolution <br />//96-08-190 granting final plat approval to Tranby Terrace 2nd Addition. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #13: <br /> <br />Request for Final Plat Approval of Northfork Oaks Third Addition; <br />Case of North Fork, Inc. <br /> <br />Tabled at applicant's request. <br /> <br />Case #14: <br /> <br />Request to Rezone Certain Property from R-1 Rural ReSidential to R- <br />3 Urban Residential; Case of New Life Church <br /> <br />Zoning Administrator Frolik reminded Council that New Life Church has acquired property on <br />the east side of T.H. #47 at about 172nd Lane. They are proposing to build their new church <br />structure on the property but it is zoned R-1 Rural ReSidential, for which churches are not a <br />permitted use. The City received formal application for a rezoning of the property to R-3 Urban <br />Residential, for which churches are a permitted use. Council introduced an ordinance on July 23 <br />to rezone the property as requested. However, during the Council discussion, there were <br />concerns expressed regarding the development potential for a high density urban parcel in the <br />rural district if the church did not become a reality. Ms. Frolik reported that staff met with the <br />City Attorney and it has been determined that City Code is not specific enough to apply 4 in 40 <br /> <br />City Council/August 13, 1996 <br /> Page 12 of 22 <br /> <br /> <br />
