The subject property currently consists of 10 acres and Mr. Sauter's future plans <br />are to subdivide the property into one commercial lot for his building and three outlots for future <br />developmentl The proposed project meets City Code reqUirements for setbacks, architectural <br />standards, landscaping, design and number of off-street parking spaces and driveway, lighting, <br />and waste storage. City Code requires loading docks to be located on the rear wall of the building. <br />Mr. Sauter's building does have two overhead doOrs proposed to be located on the front wall of <br />the building. These overhead doors will not function, as loading docks but will be used for track <br />access into the building, which Mr. Sauter indicates is crucial to his operation. The site plan <br />proposes that these overhead doors will be color matched to the building walls and the office <br />portion of the structure, which will be' faced with exposed aggregate, will protrude from the front <br />wall to draw attention away from the overhead doors. Ms. Frolik continued that there is off-street <br />parking area for trucks and equipment that will be developed behind the building that is proposed <br />to be surfaced with Clasg 5 and finished with B-612 concrete curbing. The Council has previously <br />waived the requirement for hard-surfacing in areas that will be exposed to the traffic of heavy <br />equipment. The Planning Commission is recommending approval. She noted that Mr. Tom <br />Sauter is present. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to approve the site <br />plan for T & G' Land, Inc. contingent upon compliance with the City Staff Review Letter dated <br />August 1, 1996. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson,. Beahen, Beyer and <br />Zimmerman. Voting No: None. <br /> <br />Case gT: Initiation of Condemnation Proceedings to Acquire the Property <br /> Identified as PIN 34'32-25-11-0017 <br /> <br />City Administrator Schroeder stated that the City has been approached by Mate Precision Tooling <br />to assist in a 67,000 square foot expansion of their current facility. The most logical expansion <br />direction appears to be to the west with the building and to the south for a new parking area. This <br />expansion has been aided by the recent offering of the Hunt property for sale allowing the majority <br />of the proposed expanded parking area to'be acquired. The remaining needed area for expansion is <br />currently controlled by a different property owner. This lot prevents the direct access of the <br />parking area to the expanded facility. Mate's agent (Ryan Companies) has made a concerted effort <br />to contact the owners to determine the asking price and the conditions of the sale of the property. <br />Due to their inability to get the required information, they are requesting that the City begin the <br />condemnation proceedings for the property. If Ryan Companies is able to gain control of the <br />property prior to the expiration of the waiting period, the City will not proceed with the <br />condemnation action. We want to start the time clock but to also work with the parcel owner. <br /> <br />Councilmember Zimmerman thought that eminent domain proceedings were more directed toward <br />public improvements. This is not a public improvement project. He felt that more negotiating <br />should be done before the City proceeds to condemn someone's property. <br /> <br />City Attorney Goodrich commented on the probable ground contamination of the parcel and <br />suggested that is findings for public improvement purpose. <br /> <br />Councilmember Beyer inquired if the City is responsible for cleaning up this parcel if it proceeds <br />with the condemnation. <br /> <br />Mr. Goodrich replied that it depends on how the City attains it. <br /> <br />Councilmember Zimmerman questioned the probable contamination. <br /> <br />City Council/August 13, 1996 <br /> Page 9 of 22 <br /> <br /> <br />
