visible than the commercial vans Council wants to get rid of. Landmark has little or no investment <br />in our City. Since the bank did not start construction by August 12, they may be in default of their <br />agreement. They have moved a trailer on the site. You should add an item to talk about these <br />matters and whether it's appropriate to cancel the development agreement as it exists today. <br /> <br />Mr. Schroeder responded to Mr. Hendriksen's issues as follows: extension of sewer and water - <br />we have an ordinance requirement to extend water and sewer to properties. This is no different. <br />The land cost - when we made City Council aware we had a buyer, Council asked for an appraisal <br />and to sell it at the appraised price - that's what we did. The construction cost - there will be a bid <br />list from which City Council can proceed with in four phases. That will be coming to Council <br />within the next couple of meetings. <br /> <br />Mr. Hendriksen stated that none of this is spelled out in the Development Agreement. <br /> <br />Mr. Schroeder stated that the understanding is we require final approval over everything. Staff did <br />review the phasing with Council. This is out on bids now. City Council will be able to identify <br />the scope of work. <br /> <br />Mr. Hendriksen asked why the parking agreement is absent. <br /> <br />Mr. Schroeder replied that it's fled up with the use of the drive and cross easements will be <br />negotiated. <br /> <br />Mr. Hendriksen stated that the parking issue is part of that. He felt they are expecting to use part <br />of the City's property for parking. The parking portion is absent from the Development <br />Agreement. <br /> <br />Mr. Schroeder stated that the City also expects to use their property and the property of Children's <br />World for our use. <br /> <br />Mr. Hendriksen questioned why we are sitting here with a trailer and asked why there was not a <br />draft agreement available. <br /> <br />Mr. Schroeder did not know if the trailer is relevant to the parking issue. <br /> <br />Mr. Hendriksen felt we have not played by all the agreements. <br /> <br />Mr. Schroeder responded that the Development Agreement contemplates all the different action <br />steps. <br /> <br />Mr. Hendriksen stated that the Development Agreement states it will be attached and it's not <br />available. The parking issue is being ignored. <br /> <br />City Attorney Goodrich stated that he has reviewed a parking agreement and he would be happy to <br />give a copy to Mr. Hendriksen. <br /> <br />Mr. Hendriksen stated he was told no draft was available. He then inquired if it is true that the <br />bank missed the deadline of August 12. <br /> <br />Mr. Schroeder replied that he would have to check on that. <br /> <br />Carol Keyser, 16967 Bison Street NW, Ramsey, regarding the closing of 171st Avenue NW, did <br />not see how City Council can do that based on one person's opinion as opposed to all others. <br />There are kids who ride bike and they have to ride on C.R. 4/63 where there is no shoulder and <br /> <br />City Council/August 27, 1996 <br /> Page 5 of 17 <br /> <br /> <br />
