City Engineer Jankowski stated that the drainage is proposed to drain to the detention pond placed <br />on the southeast comer of the site and the overflow would be into the highway right-of-way ditch. <br />MnDOT will need documents showing the rate of discharge. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to approve the plan <br />proposal for the Burger King facility contingent upon compliance with the City staff review letter <br />dated August 27, 1996, with the exception of eliminating the Highway #10 access, and resolving <br />the access point on Ramsey Boulevard with the Anoka County Highway Department. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen and Zimmerman. <br />Voting No: None. Absent: CouncilmemberBeyer. <br /> <br />Case #5: <br /> <br />Request for Final Plat Approval of Business Park 95 - 3rd Addition; <br />Case of City of Ramsey <br /> <br />Zoning Administrator Frolik stated that the City of Ramsey is in the process of platting two more <br />lots in Business Park 95 to accommodate the new facilities for Barkela Manufacturing and Capco. <br />The area to be platted is proposed to be subdivided into two industrial lots for development and <br />two outlots for future development. The lots will receive access from McKinley Street. Both lots <br />meet the one-acre minimum area requirement. Lot 1, Block 1, is 10 feet deficient of the <br />requirement for 200 feet of frontage on a public road and will be modified accordingly. The <br />Planning Commission and City staff are recommending approval. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Peterson to adopt Resolution <br />g96-09-255 granting final plat approval to Business Park 95 3rd Addition. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beahen, Peterson and Zimmerman. <br />Voting No: None. Absent: Councilmember Beyer. <br /> <br />Case #6: <br /> <br />Proposed Ordinance to Amend the R-1 and R-2 Residential Districts <br />to Establish Churches as Permitted Uses <br /> <br />Zoning Administrator Frolik reminded Council that New Life Church submitted an application to <br />rezone certain property in the R-1 Rural Residential District to R-3 Urban Residential to permit <br />development of their new facility on the site. Council adopted findings of fact and introduced an <br />ordinance to rezone the property as requested. However, during the Council discussion, there <br />were concerns expressed regarding the development potential for a high-density urban parcel in the <br />rural district if the chumh did not become a reality. As a follow-up to those comments, staff met <br />with the City Attorney and it was determined that Council's concerns were valid. It was agreed by <br />staff and City Council that the better alternative would be to amend the R-1 and R-2 Residential <br />Districts to include churches. Council directed staff to draft an ordinance that would establish <br />churches as permitted uses in non-residential structures. Such ordinance was drafted to allow <br />churches as permitted uses in the R-1 and R-2 Residential Districts, except that no church would be <br />permitted in a residential structure without a conditional use permit. A public hearing was held in <br />front of the Planning Commission on September 3. The Commission amended the ordinance to <br />also state that a church structure cannot be converted to a commercial use upon the church's <br />expiration of occupancy and/or the conditional use permit, without the new commercial use <br />obtaining a separate conditional use permit. <br /> <br />Councilmember Zimmerman felt this is a step in the right direction. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to introduce the <br />ordinance to establish churches as permitted uses in the R-1 and R-2 Residential Districts. <br /> <br />City Council/September 9, 1996 <br /> Page 9 of 14 <br /> <br /> <br />
