She described the exterior finish of brick and explained that the <br />project meets City Code requirements for lot coverage, setbacks, design and number of off-street <br />parking spaces and driveways, screened waste enclosure, lighting, landscaping and screening. <br />The Planning Commission is recommending approval contingent upon the access issue being <br />worked out. <br /> <br />City Engineer Jankowski stated that he has requested a more detailed drainage plan. He is asking <br />for a detention pond behind the store and that we install a 12" watermain up the east side of the <br />property. Casey's is amenable to both these requests. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to approve the site <br />plan proposal for the Casey's General Store contingent upon compliance with the City staff letter <br />dated August 30, 1996. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen and Zimmerman. <br />Voting No: None. Absent: Councilmember Beyer. <br /> <br />Case /14: Request for Site Plan Review; Case of Dolphin Fast Food, Inc. <br /> <br />Zoning Administrator Frolik reported that Dolphin Fast Food, Inc. has submitted a site plan for the <br />development of a 3,000 square foot Burger King restaurant on the comer of Ramsey Boulevard <br />and Highway gl0. The plan proposes to retain the existing access onto Highway gl0. <br />Preliminary verbal comments from MnDOT are that retaining a fight-in/fight-out only onto #10 is <br />acceptable as long as it is on the west border of the property so that it may be a shared driveway <br />with the vacant parcel to the west when it is developed. She explained that the City Engineer <br />originally recommended elimination of the Highway gl0 access. However, it is likely that at some <br />future date the County will install a median on Ramsey Boulevard south of the railroad tracks to the <br />intersection with Highway gl0. The lack of Highway gl0 access and a median on County Road <br />#56 would prohibit persons traveling west or east on gl0 or north on Ramsey Boulevard from <br />entering the facility. The median would also prohibit a left mm from the restaurant to go north on <br />Ramsey Boulevard. The site plan also proposes to relocate the existing access on Ramsey <br />Boulevard to the north. Anoka County has recommended that the access onto Ramsey Boulevard <br />align with the access to Holiday on the east side of Ramsey Boulevard. This is not feasible as <br />moving the Burger King access to the south to align with Holiday's will interfere with the traffic <br />lane for the drive-up window; and Holiday's entrance cannot be relocated to the north because of <br />the detention pond in that area. Ms. Frolik continued that the County and the Planning <br />Commission have also noted the need to verify that the slructure meets the 80-foot setback from the <br />centerline of the Ramsey Boulevard right-of-way. The applicant has indicated that the <br />measurement will be verified and the site plan modified accordingly. City Code requires a 20-foot <br />wide landscaped area along all public streets and in the B-3 Highway Business District, there is a <br />17.5 foot no-activity zone adjacent to Highway gl0. The site plan does meet the 20-foot landscape <br />requirement along Ramsey Boulevard, however, that area reduces to 15 feet along Highway #10, <br />which also means that the drive-up traffic lane on the south side of the building encroaches the no- <br />activity zone by about two feet. The primary intent of the 17-foot no-activity zone was to stop the <br />use of highway right-of-way for retail display areas. In this case, staff is recommending approval <br />of the five-foot deviation in order to retain as much area as possible on the north side of the <br />property for septic systems. The turf establishment on the south property line can be extended a <br />couple of feet into the road right-of-way to make up the difference. As for the 17-foot no-activity <br />zone, the traffic lane for the drive-up window is not a permanent use or obstruction like a display <br />area, therefore, staff recommends approval of that two-foot deviation. <br /> <br />Mr. Dolphin gave Ms. Frolik documentation showing they meet the 80-foot setback from Ramsey <br />Boulevard. <br /> <br />City Council/September 9, 1996 <br /> Page 8 of 14 <br /> <br /> <br />
