the developer to inform the purchasers of the restricted yard area on these lots. The lots will <br />receive public access from 149th Lane. The public improvements will be installed as a private <br />project with no financial participation on the part of the City. As recommended at the time of <br />preliminary plat, park dedication will be satisfied with a cash payment. The Transportation Impact <br />Fee will be applied toward traffic signals at the intersections of 142nd Avenue and Xkimo Street <br />with T.H. g47. Ms. Frolik noted that Mr. Menkveld is present if anyone has questions. <br /> <br />Motion by Councilmember Bcyer and seconded by Councilmember Peterson to adopt Resolution <br />//96-09-270 granting final plat approval to Ramsey Meadows 4th Addition contingent upon <br />compliance with City staff review letter dated September 19, 1996. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Peterson, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #5: Request for Preliminary Plat Approval of Alpaca Estates 4th <br /> Addition; Case of Haakon Jarnes <br /> <br />Zoning Administrator Frolik stated that Haakon James is requesting preliminary plat approval of <br />Alpaca Estates 4th Addition. The property is approximately 35 acres in size and is located at the <br />southeast comer of the intersection of Highway gl0 and Llama Street. The subdivision proposes <br />to plat 11 commercial lots and one outlot. All of the lots exceed the minimum area and dimension <br />requirements for the B-3 Highway Business District. Development of the plat will include the <br />construction of a westerly extension of Riverdale Drive and improvements to Llama Street, south <br />of Highway glO. Park dedication consists of a combination of trail and cash. The Planning <br />Commission conducted a public hearing and there were no verbal or written comments received. <br />She noted that Mr. James was in the audience. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to approve the <br />preliminary plat for Alpaca Estates 4th Addition. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit for an Off-Site Advertising <br />Sign; Case of Holm's Super Bowl, Inc. <br /> <br />Zoning Administrator Frolik noted that Tim Holm and Wayne Bidwell are present and are <br />requesting an off-site advertising sign on the Bill Dubats property at 6740 Highway gl0 NW. City <br />Code restricts signs to identifying the business or service offered at the parcel on which the sign is <br />located. Mr. Holm has stated he feels he is a unique situation being located one block off the <br />highway and the lack of identification of the bowling alley on Highway gl0 has an adverse impact <br />on his business. He has submitted an application for a conditional use permit for an off-site sign. <br />Ms. Frolik observed that the previous owner of Super Bowl had a lawful non-conforming <br />identification sign on the Dubats property and for various reasons, removed it knowing full well <br />that under the new regulations it could not be replaced without obtaining a conditional use permit <br />from the City. Mr. Holm feels the lack of identification on the highway has hurt the business and <br />he would like to replace the 96 square foot sign in its previous location on the Dubats property. <br />She pointed out that the Dubats property already has an 84 square foot lawful conforming sign on <br />Highway gl0 and a 24-square foot lawful non-conforming sign on Riverdale Drive. Approval of <br />Mr. Holm's request would result in three, free-standing signs on the parcel totaling 180 square feet <br />of sign space - Code permits one at 100 square feet. There are numerous businesses that would <br />like to be identified on Highway gl0 and staff feels that approval of Mr. Holm's request would set <br />a precedent.
