Councilmember Beahen stated that the sign she is talking about would be temporary. <br /> <br />Ms. Frolik expressed concern about how much the Super Bowl wants to invest in a temporary <br />sign. <br /> <br />Mayor Hardin stated that it's possible to table this item for a week or two and try to work <br />something out. <br /> <br />Motion by Mayor Hardin and seconded by Councilmember Beahen to table this issue and re- <br />discuss it one week from tonight. <br /> <br />Further discussion: Mr. Schroeder stated he would get more information on signs - cost, etc., plus <br />staff would have time to have more conversation with Mr. Dubats. He suggested that the <br />Economic Development Commissioners would be called so they could be in on the discussion <br />also. Councilmember Peterson stated that we could eliminate smaller signs if we have a big one <br />for all the businesses in the area. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case g7: <br /> <br />Request for a Conditional Use Permit for a Personal Communication <br />Service Tower; Case of American Portable Telecom <br /> <br />Zoning Administrator Frolik reported that the City has received an application from American <br />Portable Telecom (APT) to construct and operate a personal communication service (PCS) tower <br />on Lot l, Block 1, HY-10 Ramsey. The applicant is proposing to construct a 165 foot self- <br />supporting lattice tower on a 50' x 50' section of the subject property. The site operations include <br />a maximum of six 5' x 3' x 3' equipment cabinets placed on a 10' x 20' cement pad. The tower <br />and cabinets will be encompassed with an 8' high chain link fence topped with three strands of <br />barbed wire. The site and access to it will be prepared with a gravel surface. There will be no <br />personnel stationed at the site. The Planning Commission conducted a public hearing and there <br />were no verbal or written comments received. The Commission noted that the proposed <br />Transportation Map in the Comprehensive Plan Amendment aligns the future westerly extension of <br />County Road #116 along the north property line of the subject property. The applicant did agree to <br />relocating their site 60 feet south of the north property line so as to not impede this future <br />transportation improvement. <br /> <br />Councilmember Zimmerman inquired if this tower would be viewed as an eye sore on Highway <br />#10. <br /> <br />City Administrator Schroeder replied that it appears from literature received from the League of <br />Minnesota Cities, that the Telecommunications Act of 1996 bars cities from actions that prohibit or <br />have the effect of prohibiting provisions for personal wireless services. It is appropriate, however, <br />for cities to establish reasonable performance standards for towers, including amateur radio <br />towers. <br /> <br />Councilmember Zimmerman inquired about what if the tower fell onto someone else's property. <br /> <br />Chuck Wendall, representing APT, stated that the tower would not fall down - it would collapse <br />within itself. <br /> <br />Council reviewed the findings of fact. <br /> <br />City Council/September 24, 1996 <br /> Page 9 of 13 <br /> <br /> <br />
