Case #2: Release of Easement Lot 1, Block 5, Rum Acre Estates <br /> <br />City Engineer Jankowski stated that when Rum Acre Estates was platted in 1974, a drainage <br />easement was granted over the entire area of Lot 1, Block 5, because a storm out-fall to the Rum <br />River was not placed as was required. Since this lot was the lowest point, it was designated for <br />storm water. In 1990, storm facilities were installed. That work provided an outlot for this lot to <br />the pond constructed between Tonto and Ute Streets. However, it is still necessary to provide for <br />the conveyance of storm water from the northeast comer of this lot where a bituminous spillway <br />drains storm water form the street to the northwest comer of the lot where the storm pipe drains <br />this lot. We request that a 50-foot permanent drainage easement be retained for this purpose and it <br />is recommended the 50 feet be left in its present condition. Staff is recommending that the owner <br />of the lot clean the storm line leading to the pond of accumulated debris and grout the rip rap on the <br />outlet as a condition of declaring the release of the temporary drainage easements and any other <br />reasonable conditions the City Council may wish to request. <br /> <br />Mayor Hardin adjourned the regular portion of the City Council meeting at 7:25 p.m. in order to <br />conduct the public hearing. <br /> <br />P0bli¢ Hearing <br /> <br />Mayor Hardin opened the public hearing at 7:25 p.m. <br /> <br />Citizen Input <br /> <br />Bruce Schluetter, 15011 Juniper Ridge Drive NW, Ramsey, asked why the occurrence of 20 to 30 <br />loads of fill came in place? He expressed concern about the water that's ponding in the area. · If <br />this occurs, what are the implications for homeowners in Rum Acre Estates? Will there be an <br />assessment? He explained that when he purchased his lot, he was told the developer would <br />provide the storm sewer and blacktop streets. The blacktop occurred and he has had no problem <br />with the drainage. He asked if he would be assessed for storm sewer if the ponding does not hold <br />water. There's a lot of water in that area. As long as the water goes away, he did not care about it. <br /> <br />Mr. Jankowski replied, with regard to the fill, it was placed in the spring and summer of this last <br />year. There should have had a mining and grading permit issued for that fill. We had one after the <br />fact. The Planning Commission will be discussing this at their meeting on Tuesday. There is the <br />alternative to make him remove the fill. With regard to what will happen with the drainage, it <br />flows into the outlet. There are pipes down to the pond between Ute and Juniper Ridge. No <br />additional drainage is required to make the water drain from that lot. He stated he has checked and <br />the outlet is functioning. The questions of whether or not Mr. Schluetter will be assessed - the <br />answer is no. He (Jankowski) did not anticipate any additional drainage is necessary. It flows <br />from the lot to the easement to the pond in Juniper Woods. <br /> <br />Mr. Schluetter asked what would happen if this does not work and added there is a lot of water in <br />the street on 151st and Juniper Ridge. If we get a hard rain, where will that water go. He doubted <br />it would drain quickly. He hoped Mr. Jankowski was right and added that he does not want to be <br />assessed. He understood this all was a done deal when he bought his lot. <br /> <br />Rex Swanson, 15041 Juniper Ridge Drive, Ramsey, stated he has the same concerns as Mr. <br />Schluetter. That intersection (Juniper Ridge Drive and 151st) draws from a long area. He <br />suggested having an engineering feasibility study conducted on that drainage pipe. He stated that <br />standing water never used to be a problem there. By changing the level of that pond, you will <br />change the way the water flows in the neighborhood.
